خلاصة:
مقاله حاضر تلاش دارد با بررسی رویکردهای نظری گوناگونی که به تبیین جرم پرداخته اند نشان دهد از دوره کلاسیک تا نظریه های پست مدرن اخیر، چرخش گفتمان آهسته اما پایداری پیرامون تلقی از جرم و تبیین آن رخ داده است. در دوره کلاسیک مجرم فردی عاقل و دارای اراده سالم فرض می شد که با گزینش فردی و به علت تصمیمات نادرست دست به ارتکاب جرم می زد؛ در رویکرد اثباتی نگرانی نظریه پردازان به شناخت افراد مجرم و روشن ساختن ابعاد و ویژگی های اساسی تر بیولوژیک، عملکرد روانشناختی معطوف می شود و آنان سعی می کنند با تقسیم بندی افراد جامعه به متعادل و غیر متعادل، پدیده جرم را تبیین نمایند؛ در نظریات مدرن، عوامل اجتماعی پیدایش جرم مورد توجه بیشتری قرار می گیرند، اما نظریات انتقادی به صورت ریشه دارتری بر نقش جامعه در پدیده مجرمانه و تعریف آن تاکید می ورزند و در نهایت نظریات پست مدرن به صورت کلی جرم را برساخته ذهنیت، زبان و قدرت دانسته و حقیقت وجودی آن را زیر سوال میبرند.
The present paper aims to explain crime by investigating various theoretical
approaches and to show that from the classic era to the recent postmodern
theories, a slow but steady cycle of discourse concerning crime has been
occurring. In the classic times, the criminal is assumed to be a sane person
with sound will who commits crime with an individualistic choice and due to
incorrect decisions; In the positivism approach, the theorists' concern is directed
at recognizing criminals and clarifying more fundamental biological aspects
and psychological performance and they seek to explain the phenomenon of
crime by dividing the people of the society into normal and abnormal people
In the modern theories the social factors causing the appearance of crime are
at the focal point while critical theories greatly emphasize on the role of the
society in the criminal phenomenon and its definition, finally postmodern
theories consider crime totally as constructed by mindset, language and power
and question its existential reality.
