هدف این تحقیق استخراج ابزارهای حقوقی و نگاه به زوایای پنهان و خلاهای حقوق محیط زیست است تا امکان استقرار تفسیر موسع از جایگاه ذینفع را در جهت امکان طرح دعاوی زیست محیطی را فارغ از تعلقات اقلیمی و تابعیتی فراهم کرده مزید بر اینکه نه تنها ورود خسارت بلکه تعرض حق به محیط زیست هم قانون انگاری شود در حوزه محیط زیست و در سطح کلان،عمده خسارتهای زیست محیطی با مجوز قانونی صادر می گیرد.از نقطه نظر شکلی نیز در ماده 2قانون آیین دادرسی مدنی منحصرا شخص یا اشخاصی امکان طرح دعوی را دارند که ذینفع در قضییه بوده و با این تعبیر، طرح دعاوی زیست محیطی درصورتی امکان پذیرکه مدعی، ورود خسارت به خود را ثابت تا بطور شکلی توان طرح دعاوی را داشته باشد، وجود این دو مانع تاثیرگذار در سطح کلان یا اجازه استقرار همه جانبه اصل پیشگیری را نمی دهد و یا اینکه امکان مطالبه خسارت و به طریق اولی صیانت از حق به محیط زیست را اعطا نمی کنددرصورتیکه برآیند پذیرش حق به محیط زیست و تفسیر موسع از جایگاه ذینفع امکان تدارک این صیانت و خسارت را سهم الوصول کرده، متقابلا دولتها را در تدوین سیاستهای قانونگذاری،اجرای قوانین و تدابیر قضایی، پاسخگوتر و البته محتاط تر می کند. شکل فزآینده ای بر توان اشخاص و البته سازمانهای مردم نهاد جهت صیانت از حق به محیط زیست و مطالبه خسارتهای زیست محیطی به نحو چشمگیری می افزاید.
