عقد نکاح در فقه اسلامی جایگاه و اهمیت ویژه‌ای دارد. در پی انعقاد نکاح، تکالیف بسیاری بر ذمّه زوجین قرار می‌گیرد. این عقد نکات حقوقی و فقهی فراوانی دارد و همچون سایر عقود از لحاظ ارکان و شروط صحت، از قواعد یکسانی پیروی می‌کند و آثار متفاوتی به دنبال دارد که بی‌شک مهم‌ترینش تداوم این بنیان است. چون مقتضای عقد نکاح تشکیل خانواده است، استمرارش از آثار مهم مربوط به این مقتضی است. شرط خیار فسخ در عقد نکاح اثر ظاهری و مطلوب ازدواج را نفی می‌کند و با مفهوم عرفی‌اش مغایرت دارد. در این مقاله دیدگاه مذاهب پنج‌گانه درباره شرط خیار فسخ در عقد نکاح را بررسی می‌کنیم و درج این شرط را خلاف مقتضای ذات عقد نکاح می‌دانیم، و باطل و مبطل‌بودن این شرط را ترجیح می‌دهیم.
The marriage contract has a special place and particular importance in Islamic jurisprudence. After the conclusion of the marriage contract, many tasks are assigned to the couple. This contract has many legal and jurisprudential points and follows the same rules as other contracts in terms of validity elements and conditions. It also has different effects, the most important of which is undoubtedly the continuation of family foundation. Since the result of the marriage contract is the formation of a family, its continuation is one of the important related effects. The condition of the termination option in the contract negates the apparent and desired effect of marriage and is contrary to its customary meaning. In this article, we examine the views of the five schools of thought regarding "the condition of the termination option" in the marriage contract and consider it to be against the nature of the contract.
