در دعاوی اصلی و طاری آنچه بیشتر به چشم میآید، تقابل یک یا چند خواهان در برابر یک یا چند خوانده و یا ورود و جلب شخص یا اشخاص ثالثی به دعوای اصلی است. پرسش آن است که آیا وفق آیین حاکم بر دعوا میتوان از شمار زیادی از اشخاص به عنوان یک طرف دعوا (خواهانها یا خواندگان) بهره برد، بدون اینکه همه ایشان به طور مستقیم در دادرسی شرکت نمایند؟ ماده 74 قانون آیین دادرسی دادگاههای عمومی و انقلاب در امور مدنی، به نحو تلویحی حکایت از شناسایی یک نوع از دعوای مدنی مینماید که متوجه اهالی غیر محصور معین از ده یا بخشی از شهر است و خواهان، صرفاً یک یا چند شخص از آنها را در دادخواست به عنوان معارض خود معرفی کرده است. با توجه به مادۀ یادشده، این نوع دعوا به صورت عام، بر مدار خواندگان و اشخاص همگروه آنها است و استثنائاً با توجه به قانون خاص مانند مادۀ 48 قانون تجارت الکترونیک در خصوص دعاوی مربوط به حقوق مصرفکننده متمرکز شده و بدین ترتیب واجد اسم و رسمی در حقوق خارجی، بهویژه حقوق آمریکا با عنوان دعوای جمعی شده است. این مقاله در اثبات ضرورت وجودی چنین دعوایی با تمرکز بر خواندگان و اشخاص همگروه آنها است.
