زمینه و هدف: در معاملات میتوان دو فرض را مطرح نمود یکی فرض علم نسبت به اصول معاملات و دیگری فرض جهل در فروعات. در زمینه معاملات، قلمرو علم و جهل گستره وسیعی را به خود اختصاص میدهد. اما این که آیا در معاملات فرض بر علم طرفین میباشد و جهل در موارد خاص فاقد ایراد است و یا آنکه جهل در چه مواردی عذر محسوب میشود و چه نوع جهلی را میتوان مورد نظر دانست، مورد توجه این مقاله است. همچنین این نوشتار به دنبال بررسی نقش جهل در عبادات و احکام کیفری است.
مواد و روشها: روش تحقیق در این مقاله به صورت توصیفی-تحلیلی انجام شده است.

یافتهها: یافتههای نگارنده حاکی از آن است که موضوع جهل به حکم یکی از قواعد مربوط به نظم عمومی است و علیالقاعده پذیرش آن بدون دلیل موجه، موجب برهم خوردن نظم عمومی میشود. با این حال فقهای معظم، موضوع جهل را در سه ساحت عبادات، معاملات و مسؤولیت کیفری به تفصیل مورد بحث قرار دادهاند.
نتیجهگیری: از کلمات فقها استفاده میشود که پیرامون حکم وضعی عبادات جاهل، میان جاهل قاصر و مقصر تفاوت است. جاهل مقصر در حکم عالم است و لذا عبادات او صحیح نیست و مؤاخذه و عقاب هم دارد ولی در خصوص ناسی به حکم و موضوع، مشهور، مطلقاً فتوا به صحت عمل او دادهاند. در معاملات عموماً جهل مورد قبول قرار گرفته است. در حقوق کیفری نیز جهل مسقط مسؤولیت کیفری و مجازات است.

FindingsThe author's findings suggest that the issue of ignorance of the law is one of the rules of public order, and accepting it without good reason disturbs public order. However, jurists have discussed the issue of ignorance in three areas of worship, transactions and criminal liability in detail.
Conclusion: According to jurisprudents, ignorant worships are not correct and are punished, but in the case of forgetfulness about the ruling and the subject, most jurists have absolutely given a fatwa about the authenticity of his actions. In transactions, ignorance is generally accepted. In criminal law, ignorance also eliminates criminal responsibility and punishment.
