يعد دليل الاعتراف المتمثل في إقرار المتهم المفصل شفوياً أو كتابياً بارتكابه جريمة معينة من أهم الأدلة التي تعتمد عليها أنظمة العدالة الجنائية المختلفة في إثبات ارتكاب المتهم للجرية المنسوبة إليه ؛ إلا أن التجربة العملية أثبتت إمكانية اعتراف متهم بريء بجريمة لم يرتكبها. ومن ثم فإن هذه الدراسة قد سعت إلى بيان دور الاعترافات غير الصحيحة في وقوع الإدانات الخاطئة والأسباب التي تؤدي إلى اعتراف متهم بريء بجرية لم يرتكبها. وقد أظهرت هذه الدراسة من خلال تحليل التجارب العملية والدراسات العلمية ذات العلاقة خطورة ظاهرة الاعترافات غير الصحيحة بوصفها أحد أهم أسباب وقوع الإدانات الخاطئةء وأنه ينبغي على أنظمة العدالة الجنائية من أجل التعامل مع هذه الظاهرة الخطرة منعاً لوقوع الإدانات الخاطثة بناءٌ على اعترافات غير صحيحة تبني مجموعة من القواعد التي من شأنها أن تكفل منع وقوع الاعترافات غير الصحيحة أو تضمن على أقل تقدير- اكتشافها حال وقوعها.
Confession evidence, which is a detailed statement by the suspect admitting all facts necessary for
conviction of a crime, is the most relied upon type of evidence by criminal justice agencies all over the world in
convicting the defendant. However, experience has shown that innocent people could confess to crimes they did
not commit. Hence, this study has sought to highlight the role that false confessions have played in the occurrence
of wrongful convictions, and the reasons that lead innocent people to confess to crimes they did not commit. It has
shown that false confessions represent one of the main causes of wrongful convictions, and, hence, criminal justice
systems have, in order to prevent the occurrence of wrongful convictions based on false confessions, to adopt
certain rules designed to prevent the occurrence of false confessions, or, at least, guarantee their discovery if they
occur.
