چکیده:
تامین مالی داوری بین المللی توسط شخص ثالث، پدیده ای نوظهور و جدید است. با وجود انواع روش های تامین مالی داوری بین المللی توسط شخص ثالث، آنچه مورد مطالعه می باشد روشی بدیع است که در آن تامین کننده ثالث هزینه دعوی خواهان در داوری را به عهده می گیرد و در صورت پیروزی خواهان، استحقاق مبلغ توافق شده را دارد اما در صورت شکست در دعوا، حق مراجعه به خواهان برای دریافت هزینه های انجام شده را ندارد. هدف این مقاله، تشریح و تحلیل چالش های اساسی مرتبط با استفاده از چنین تاسیسی است. اعتبار این نهاد در نظام حقوقی کشورهای مختلف ، با توجه به نبود مقررات و همچنین تاثیر برخی از مفاهیم موجود محل نقد نقادان است. گسترش روز افزون استفاده از آن ایجاب می کند این پدیده سریعاً خود را تنظیم نماید و برای چالش های اساسی پیرامون خود پاسخ های روشنی ارائه کند. شناخت چالش ها و راهکارها می تواند ضمن کمک به شناسائی و پذیرش این نهاد در کشورهای مختلف، به ویژه در ایران، زمینه را برای تشویق اشخاص به سرمایه گذاری در این حوزه فراهم نموده و نهایتاً منجر به تقویت جایگاه کشورها به عنوان مقرّ داوری های بین المللی گردد.
Third-party funding in international arbitration (TPF), is a new and emerging
phenomenon. Despite the variety of third-party funding arrangements for
international arbitration, what is being studied is a new way in which a thirdparty
funder will deserve an agreed amount with his client if his client wins,
but he has no right to refer to the client for the costs incurred when failing.
The purpose of this article is to describe and analyze the major challenges
associated with using such a foundation. The validity and position of this
phenomenon in the legal system of different countries, due to the lack of
regulations, as well as the impact of some concepts, are the subject of
discussion. On the other hand, its growing use requires that this phenomenon
be quickly regulated, and provide clear answers to the issues and the major
challenges surrounding it. Recognition of the challenges and solutions can
help to identify and accept this entity in different countries, especially in Iran,
and provide the ground for encouraging individuals to invest in this field, and
ultimately, it strengthens the position of countries as the seat of international
arbitration.
