چکیده:
زمینه و هدف: با دقت در قواعد بنیانی حاکم بر کیفرها، به راحتی میتوان فهمید که اسلام با توجه به مصلحتهای جامعه، بر اساس کرامت به شخصیت بزهکار نیز توجه خاصی داشته است؛ در پژوهش حاضر به دنبال پاسخ به این پرسش هستیم که اصل کرامت انسانی چه نقشی در به کارگیری مجازاتهای جایگزین حبس دارد.
مواد و روشها: این تحقیق از نوع نظری است، روش تحقیق به صورت توصیفی ـ تحلیلی میباشد و روش جمعآوری اطلاعات به صورت کتابخانهای است که با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
ملاحظات اخلاقی: در نگارش پژوهش حاضر، ضمن توجه به اصالت متون، صداقت و امانتداری رعایت شده است.
یافتهها: چالشهای مجازات حبس برای افراد انسانی فقط از جنبه ماهیت آن و تعارض با حق آزادی که جلوه اصل کرامت انسانی است، نخواهد بود، بلکه تبعات مختلفی برای کیفر حبس وجود دارد که تبعات مزبور نیز به نوبه خود، میتواند زمینه نقض کرامت انسانی را فراهم آورد.
نتیجهگیری: با توجه به اینکه کرامت ذاتی انسان قابل سلب نمیباشد، اصل بر این است که آثار آن از جمله آزادیهای انسان نیز قابل سلب نباشد. به بیان سادهتر، سلب آزادی انسانها حتی در ارتباط با مجازاتها یک امر استثنایی و خلاف اصل میباشد، در نتیجه در راستای اعمال مجازات در مواردی که شارع صراحتا و در قالب حدود، مجازات حبس تعیین نکرده است، به نظر میرسد که قضات با در نظرگرفتن اصل کرامت و احترام به شخصیت انسانی باید مجازاتهای جایگزین حبس را مطمح نظر داشته باشند.
Background and Aim: By paying attention to the basic rules governing punishments, it can be easily understood that Islam, according to the interests of society, has also paid special attention to the personality of the criminal on the basis of dignity. In the present study, we seek to answer the question of what role the principle of human dignity plays in the application of alternative punishments to imprisonment. Materials and Methods: This research is of theoretical type. The research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: The challenges of imprisonment for the human persons are not only in terms of its nature and conflict with the right to liberty that precedes the principle of human dignity. Moreover, there are various consequences for the punishment of imprisonment, and these consequences themselves can provide the basis for violating human dignity. Conclusion: Given that the inherent dignity of man cannot be taken away, its effects and consequences, including human freedoms, can not be taken away. To put it simply: deprivation of human liberty, even in relation to punishment, is exceptional and unprincipled. Consequently, in order to impose punishment in cases where the Shariah has not determined the punishment of imprisonment explicitly and in the form of "hudud", it seems that judges should apply alternative punishments to imprisonment, taking into account the principle of dignity and respect for human personality.
