چکیده:
فعالیت اطلاعاتی از جمله امور لازم در هر حکومتی، است؛ اما از آنجاکه این فعالیت، گاهی مستلزم اِعمال رفتارهای غیرشرعی است، از مؤلفههای چالشی در نظام سیاسی اسلامیِ مبتنی بر رفتارهای شریعتمدار است. به همین علت است که بحث مذکور، در حوزهی فقهی و در خصوص مباحث حکمرانی اسلامی، ادارهی مطلوب جامعه و کارآمدی حکومت اسلامی، مورد توجّه اندیشمندان قرار گرفته است. تحقیق حاضر در چارچوب فقه سیاسی، بر اساس روش توصیفی - تحلیلی و مبتنی بر روششناسی اجتهاد، درصدد تبیین رویکردِ حجیّت شرعی رفتارهای کارگزاران فعالیّتهای اطلاعاتی در فقه اسلامی و کارآمدی نظام اسلامی در فائق آمدن بر دشمن در حوزههای اطلاعاتی و وصول به غایات اسلام در حوزهی حکمرانی است. طبعاً فعالیّت اطلاعاتی در صورتی میتواند از سوی کارگزاران اطلاعاتی مورد استفاده قرار بگیرد که مقیّد به ضوابطی برآمده از شریعت، عقل یا عرف باشد که از آن جمله میتوان به ضوابطی چون عدالتورزی، حفظ نظام، انطباق حداکثری بر شریعت، انطباق بر خرد جمعی، اعتدال، تحقق غایات شرع، مصلحتسنجی و حفظ جان مسلمانان، اشاره کرد. با افتراض فعالیّتهای اطلاعاتی در نظام اسلامی در راستای برتریجویی بر دشمن و حفظ نظام اسلامی، ضمن تفکیک رفتارهای بهظاهر مخالف شریعتِ کارگزاران اطلاعاتی به رفتارهای فردی و حاکمیّتی و تأکید بر اصل عدم ارتکاب رفتارهای غیرشرعی، در این تحقیق نشان داده میشود که تنها مواردی در حوزهی امور فردی و حاکمیّتی قابلقبول خواهد بود که رفتارهای اطلاعاتی از سوی کارگزاران حکومتی، ذیل ضوابط عامّ فقهی قرار گرفته و در راستای تحقّق غایات شریعت به کار گرفته شود.
Intelligence activities are necessary for every government. However, since they may involve religiously illegitimate behaviors, they pose a challenge to an Islamic political system that is based on Sharia. This is why the issue has drawn the attention of scholars in the field of jurisprudence, particularly the issues of Islamic governance, ideal administration of the society, and efficiency of the Islamic government. The present study is conducted in terms of political jurisprudence, drawing upon the descriptive-analytical method and the methodology of ijtihad. It seeks to account for the Sharia-based legitimacy of intelligent agents in Islamic jurisprudence and the efficiency of the Islamic government in overcoming its adversaries in intelligence matters to achieve the Islamic objectives in governance. To be sure, agents involved in intelligence activities may be committed to Sharia-based, rational, or commonsensical regulations such as justice, protection of the order, maximal conformity to Sharia, conformity to collective reason, moderation, realization of religious objectives, exigencies, and protection of the lives of Muslims. Assuming that intelligence operations in the Islamic government are intended as means of overcoming the enemies and protecting the Islamic system, this research distinguishes the apparently illegitimate acts of intelligence agents into individual and governmental acts and highlights the primacy of refraining from committing anti-Sharia behaviors. Moreover, it shows that individual and governmental anti-Sharia practices are acceptable only if they fall under general jurisprudential principles and criteria, serving the ultimate purposes of Sharia.
