چکیده:
کنوانسیون 1982 حقوق دریاها، ذیل بند سوم کنوانسیون 1982 حقوق دریاها، جزایر صخرهای را به دو نوع صخرههای برخوردار از منطقهی انحصاری اقتصادی و فلات قاره یا غیربرخوردار از این مناطق تقسیم نموده است و ملاک این تقسیمبندی، ظرفیت سکونت انسانی یا حیات اقتصادی خوداتکا تعیین شده است. نوع نگارش این بند و چالشهای انطباق آن با واقعیتهای جغرافیایی بسیار متنوع در کرهی زمین، تفاسیر گوناگون دولتهای ذینفع را در خصوص ملاک تعیین و تشخیص نوع صخرهها از یکدیگر رقم زده است. در مواردی این اختلافات، دادرسیهای بینالمللی را سبب شده است و یکی از مهمترین این موارد، دادگاه داوری دریای چین جنوبی است. رأی صادره از این دادگاه در 2016 به حل اختلافات فیلیپین و چین پیرامون جزایر صخرهای دریای چین جنوبی در خلال تفسیر ماده 121 پرداخته است و نهایتاً هیچیک از موارد مورد ادعای چین را، با اعمال نوعی سختگیری، جزیرهی صخرهای برخوردار از مناطق دوگانه ندانسته است. نوشتار حاضر با تبیین مفاهیم کلیدی در نظام حقوقی جزایر، اعم از جزایر، جزایر صخرهای، آبسنگها، برآمدگیهای جزری و جزایر مصنوعی، به تبیین ماده-ی 121 کنوانسیون و جایگاه آن در حقوق بینالملل عرفی میپردازد و سپس شاخصهای تمیز صخره-های دارای قابلیت سکونت یا حیات اقتصادی خود و تأثیر این پدیدههای دریایی بر تحدید حدود مناطق دریایی را از منظر رأی داوری یادشده طرح مینماید.
Under The Article 121(3) of Convention on the law of the Sea (UNCLOS) rocks which cannot sustain human habitation or economic life of their own shall have no exclusive economic zone or continental shelf. Therefore, the article implies that rock islands are divided into two categories including those enjoying exclusive economic zone and continental shelf and those not. The ambiguity of the article beside the great variety of geographical formations resulted in diverse interpretations of the text concerning the type of rock islands. The South China Sea Arbitration Award (2016) which decided on the Philippines-China dispute is a thorough example among international legal hearings of interpreting rocks, mentions in the 3rd paragraph of the article 121 of UNCLOS. This article clarifying key terms in the legal regime of island in Law of the Sea including islands, rock islands, reefs, low-tides elevations, and Artificial islands, interprets the article 121(3) and customary rules on it, and then, influential elements in distinction of rock islands on the basis of capacity of human habitation or economic life of their own from the perspective of the arbitration tribunal.
