چکیده:
آﻗﺎی ﻣﺤﻤﺪ ﻣﺠﺘﻬﺪ ﺷــﺒﺴﺘﺮی در ﯾﮑﯽ از ﯾﺎدداﺷﺖﻫﺎی ﺧﻮد ﺑﺎ ﻋﻨﻮان » ﭼﺮا دوران ﻋﻠﻢ اﺻــﻮل و اﺟﺘﻬﺎد ﻓﻘﻬﯽ ﺑﻪ ﭘﺎﯾﺎن رﺳــﯿﺪه اﺳــﺖ؟« ﻣﺪﻋﯽ اﺳﺖ از ﺻﺪر اﺳﻠﺎم ﺗﺎ دوران ﭘﯿﺶ از رﻧﺴـــﺎﻧﺲ ﻓﻘﯿﻬــﺎن ﺑــﺎ اﺗﮑﺎ ﺑﺮ ﯾﮏ ﻧﻈﺮﯾﻪ ﮐﻠﺎﻣﯽ در ﺗﻤﺎم ﻗﻠﻤﺮوﻫﺎی زﻧﺪﮔﯽ آﯾﯿﻨﯽ ﯾﺎ اﺟﺘﻤﺎﻋﯽ، ﺳﯿﺎﺳﯽ و اﻗﺘﺼﺎدی ﻣﺴﻠﻤﺎﻧﺎن ﺗﮑﻠﯿﻒ ﺗﻤﺎم ﻣﺴﺎﺋﻞ را آن ﻫﻢ ﻓﻘﻂ ﺑﺎ اﺳــﺘﻨﺒﺎط از ﻗﺮآن ﮐﺮﯾﻢ و ﺳــﻨﺖ و اﺟﺘﻬﺎد ﻓﻘﻬﯽ در آندو ﻣﻨﺒﻊ روﺷــﻦ ﻣﯽﮐﺮدﻧﺪ. اﯾﻦ روش؛ اﻣﺎ ﭘﺲ از دوران رﻧﺴﺎﻧﺲ و ﻫﺠﻮم ﻣﺴﺎﺋﻞ ﺟﺪﯾﺪ و ﻣﺴﺘﺤﺪﺛﻪ ﻫﻢ اداﻣﻪ داﺷﺘﻪ؛؛ اﻣﺎ ﺑﻪﺗﺪرﯾﺞ و ﺑﻪوﯾﮋه ﭘﺲ از اﻧﻘﻠﺎب اﺳﻠﺎﻣﯽ ﺑﺎ ﻣﺸﮑﻞ ﺟﺪی روﺑﻪرو ﺷﺪ؛ زﯾﺮا ﻣﺴﺎﺋﻠﯽ ﭘﺪﯾﺪ آﻣﺪ ﮐﻪ ﻫﯿﭻ ارﺗﺒﺎط و ﻣﻨﺸﺄی در ﮐﺘﺎب و ﺳﻨﺖ ﻧﺪاﺷﺘﻪاﻧﺪ؛ در ﻧﺘﯿﺠﻪ ﮐﻞ ﻓﺘﺎوای ﻓﻘﯿﻬﺎن دراﯾﻦﺑﺎره ﻫﻢ ﻓﻘﻂ ﻣﺒﺘﻨﯽ ﺑﺮ اﻣﻮر ﻋﻘﻠﺎﯾﯽ و ﻋﻠﻮم روز ﺑﻮده و رﯾﺸــﻪای در ﮐﺘﺎب و ﺳــﻨﺖ ﻧﺪارﻧﺪ. در ﺣﻘﯿﻘﺖ اﯾﻦ ﻋﻠﻮم روز ﻫﺴــﺘﻨﺪ ﮐﻪ ﺗﮑﻠﯿﻒ ﻣﺴﺎﺋﻞ ﻣﺴﺘﺤﺪﺛﻪ را روﺷﻦ ﻣﯽﮐﻨﻨﺪ و ﻧﻪ ﻋﻠﻢ اﺻﻮل و اﺟﺘﻬﺎد ﻣﺼﻄﻠﺢ ﻓﻘﻬﯽ؛ ﺑﻨﺎﺑﺮاﯾﻦ ﻣﯽﺗﻮان ادﻋﺎ ﮐﺮد ﮐﻪ دوران ﻋﻠﻢ اﺻﻮل و اﺟﺘﻬﺎد ﻓﻘﻬﯽ ﺑﻪ ﭘﺎﯾﺎن رﺳﯿﺪه اﺳﺖ. ﻣﻘﺎﻟﻪ ﭘﯿﺶ رو در دو ﺟﻬﺖ ﺑﻪ ﻧﻘﺪ ﻣﺪﻋﯿﺎت آﻗﺎی ﻣﺠﺘﻬﺪ ﺷــﺒﺴــﺘﺮی دراﯾﻦﺑﺎره ﭘﺮداﺧﺘﻪ اﺳﺖ؛ اﺑﺘﺪا ﻧﻘﻄﻪ ﻧﻈﺮﻫﺎی وی درﺑﺎره ﻧﻈﺮﯾﻪ ﭘﺸﺘﯿﺒﺎن اﺟﺘﻬﺎد ﻓﻘﻬﯽ ﺑﻪ ﻧﻘﺪ ﮐﺸﯿﺪه ﺧﻮاﻫﺪ ﺷﺪ ﺳﭙﺲ ﻧﺘﯿﺠﻪﮔﯿﺮی وی ﻣﺒﻨﯽ ﺑﺮ ﻋﺪم ﮐﺎراﯾﯽ اﯾﻦ ﻧﻈﺮﯾﻪ ﻣﻮرد واﮐﺎوی ﻗﺮار ﮔﺮﻓﺘﻪ و ﺿﻤﻦ ﻧﺸﺎندادن ﻣﻐﺎﻟﻄﻪﻫﺎ و اﺷﺘﺒﺎهﻫﺎی ﻓﺎﺣﺶ ﻋﻠﻤﯽ وی، ﺑﻪ اﺛﺒﺎت اﯾﻦ ﻣﺴﺌﻠﻪ ﻣﯽﭘﺮدازد ﮐﻪ ﻋﻠﻢ اﺻﻮل ﺑﺎ ﺑﺎﻟﻨﺪﮔﯽ و ﭘﯿﺸﺮﻓﺖ ﺧﻮد و اﺟﺘﻬﺎد ﻓﻘﻬﯽ ﺑﺎ ﭘﻮﯾﺎﯾﯽ ﺧﻮد ﻣﯽﺗﻮاﻧﺪ ﭘﺎﺳﺦﮔﻮی ﺗﻤﺎم ﻣﺴﺎﺋﻞ ﻣﺴﺘﺤﺪﺛﻪ و ﺟﺪﯾﺪ ﺑﺎﺷﺪ و ﻣﻮاردی ﮐﻪ ﺗﻮﻫﻢ ﺷﺪه ﮐﻪ ﺗﺎﺑﻊ روشﻫﺎی ﻋﻘﻠﺎﯾﯽ ﺻﺮف و ﻧﻪ ﻣﺴﺘﻨﺒﻂ از ﮐﺘﺎب و ﺳﻨﺖ اﺳﺖ، اﺛﺒﺎت ﺧﻮاﻫﺪ ﺷﺪ ﮐﻪ اﺻﻮﻟﺎ از ﺳﻨﺦ ﻣﺴﺎﺋﻞ اﺳﺘﻨﺒﺎﻃﯽ ﻧﺒﻮده ﺑﻠﮑﻪ اﺑﺰارﻫﺎی اﺟﺮاﯾﯽ اﺣﮑﺎم اوﻟﯿﻪ ﯾﺎ از ﺳﻨﺦ اﺣﮑﺎم ﺣﮑﻮﻣﺘﯽ و اﺧﺘﯿﺎرات ﺣﺎﮐﻢ ﺑﻤﺎ ﻫﻮ ﺣﺎﮐﻢ اﺳﺖ ﮐﻪ روشﺷﻨﺎﺳﯽ ﺧﺎص ﺧﻮد را دارد.

In fact, these science of the day illuminate the new issues, and no Jurisprudential principles and jurisprudent "independent reasoning". Therefore, it can be claimed that the era Jurisprudential principles and jurisprudent "independent reasoning" has come to an end. This article has been criticized by Mr. Mojtahed Shabestari in two directions: first, his points of view on the theory of the support of jurisprudent "independent reasoning" will be criticized, then to analyze his conclusion about ineffectiveness this theory, and revealing his fallacy and profound scientific mistakes, It is proved that the science of Jurisprudential principles with its progress and jurisprudent "independent reasoning" with their dynamism can answer all the new issue, and it will also be proved that the illusions that are subjected to rational methods and no dependent on the Book and the Tradition, Basically, it's not a matter of inferiority but the it's executive instruments of the first Judgments, or the type of government Judgments and options of governor that has its own methodology.
