چکیده:
دولت اسلامی، خشونت و توحش بیحدوحصر خود را با هدف تولید و انتشار جهانیِ ویدئوهایی که جنایات ارتکابی این دولت در آنها ضبط میشود، با فناوریهای دیجیتالی و سایبری همراه ساخته است. مقالة پیش رو مبتنی بر این استدلال است که افرادی که در دولت اسلامی (داعش) اقدام به ساخت و انتشار این ویدئوهای جنایتبار میکنند، مطابق حقوق بینالملل، مرتکبین جنایات جنگی شناخته میشوند. مقالة حاضر در بخش اول، پس از معرفی پدیدة نوین ویدئوهای جنایتبار، در بخش دوم به بررسی ارتباط میان حقوق بینالملل و موضوع تبلیغات در زمان جنگ و صلح میپردازد. سپس در بخش سوم استدلال میکند که این ویدئوهای جنایتآمیز، ناقض قوانین حقوق بینالملل بشردوستانه و از مصادیق جنایات جنگی هستند؛ و درنهایت (در بخشهای چهارم و پنجم) با طرح انتقادات وارده به نظر و استدلال فوق و پاسخ به این نقدها، نتیجهگیری مینماید.
The Islamic State has combined its extreme violence with digital and cyber technologies to produce and distribute globally videos recording atrocities it commits. This article argues that those in the Islamic State who make and distribute these atrocity videos are committing war crimes under international law. After introducing the unprecedented phenomenon the atrocity videos represent (i.), the article first examines the relationship between international law and propaganda in war and peace; (ii.) The article then argues the atrocity videos violate prohibitions in international humanitarian law and constitute war crimes; (iii.) The article concludes by presenting criticisms of this argument and responses to the critiques (iv.).
