چکیده:
سوخترسانی، فعالیت مجاز و جلوهای از آزادی دریانوردی است. رسیدگی به ابعاد مختلف سوخترسانی کشتی خارجی در دریاهای آزاد در صلاحیت دولت صاحب پرچم است. اختلافنظر طرفین دعوا در پرونده کشتی نوراِستار، پیش روی دیوان بینالمللی حقوق دریاها و ارتباطدادن آن با اعمال صلاحیت دولت ساحلی از طریق دولت ثالث در امور ذیل صلاحیت دولت صاحب پرچم، فاقد سابقه است. مطالعه پرونده نوراِستار با روش توصیفی تحلیلی و اتکا به رویهقضایی دیوان بینالمللی حقوق دریاها، موضوع و هدف این نوشتار و واجد نوآوری است. سؤال اصلی پژوهش این است که حق آزادی دریانوردی کشتی خارجی در پوشش فعالیت سوخترسانی، با اعمال صلاحیت دولت ساحلی در رویهقضایی دیوان بینالمللی حقوق دریاها چه ارتباطی دارد؟ یافتههای پژوهش نشان میدهد که حق آزادی دریانوردی کشتی خارجی در ارتباط مستقیم با اعمال صلاحیت دولت ساحلی است. اما بر اساس رویه دیوان بینالمللی حقوق دریاها، سوخترسانی کشتی خارجی در دریاهای آزاد، وقتی که تمام یا بخشی از سوخترسانی کشتی خارجی در دریای سرزمینی یا منطقه نظارت آن دولت انجام شده باشد در صلاحیت دولت ساحلی نیست. در این شرایط، استناد دولت ساحلی به حق اعمال صلاحیت در امور کشتی خارجی در دریای سرزمینی کفایت نمیکند، هرچند که کشتی خارجی بعد از سوخترسانی به دریای سرزمینی آن دولت یا دولت ثالث، برگشته و تحت کنترل مستقیم قضایی آن دولت قرار گرفته باشد.
Bunkering is an authorized activity and a manifestation of freedom of navigation. Prosecution of different aspects of foreign ship bunkering is within the jurisdiction of the flag State when it is carried out on the High Seas. Dispute of parties over the M/V “Norstar” case before the ITLOS in this situation and compared with the exercise of Coastal State jurisdiction by third State in affairs of flag State jurisdiction has no comparable history. Studying Norstar case with a descriptive-analytical approach and relying on jurisprudence of the ITLOS is the subject and purpose of this article. The main issue is the relationship between freedom of navigation rights in the mask of bunkering with the exercise of coastal State jurisdiction in the jurisprudence of the ITLOS. Research findings show that the right to freedom of navigation of a foreign ship is directly related to exercise of Coastal State jurisdiction. But bunkering in High Seas is not under jurisdiction of the Coastal State when all or part of bunkering of the foreign ship has not taken place in its Territorial Sea or Contiguous Zone in the jurisprudence of the ITLOS. In these circumstances, Coastal State’s reliance on the right to exercise jurisdiction over the foreign ships in the Territorial Sea does not suffice, although the foreign ship has returned to its Territorial Sea or within the jurisdiction of a third State after bunkering and is under direct judicial control.

لذا سؤال اصلي پژوهش اين است که حق آزادي دريانوردي کشتي خارجي در پوشش فعاليت سوخت رساني با اعمال صلاحيت دولت ساحلي در رويه قضايي ديوان بين المللي حقوق درياها چه ارتباطي دارد؟ فرض بر اين است که دولت ساحلي در مناطق دريايي تحت صلاحيت يا حاکمه ، مجاز به مداخله در امور کشتي خارجي نيست ، مگر اينکه چارچوب مقررات کنوانسيون را رعايت کند.

لذا از اين منظر، قضات ديوان بين المللي حقوق درياها معتقدند که سوخت رساني در درياهاي آزاد، جلوه اي از آزادي دريانوردي ٢٥ است و در صلاحيت دولت صاحب پرچم قرار ميگيرد که بر اساس مقررات کنوانسيون و ديگر قواعد حقوق بين الملل براي دولت ها قابل ارزيابي و پيگيري است .
