چکیده:
قانون اساسی مبنای نظارت بر شوراها را در اصول 105 و 106 قانون اساسی پیشبینی کرده است. لیکن به وضوح نامی از مرجعی خاص در جهت انجام این نظارت نیامده است. اصل 173 قانون اساسی، به منظور رسیدگی به شکایات، تظلمات و اعتراضات مردم نسبت به مامورین واحدها یا آییننامههای دولتی و احقاق حقوق آنها، دیوانی به نام دیوان عدالت اداری زیر نظر رئیس قوه قضاییه تاسیس و تعیین حدود اختیارات و نحوه عمل آن را به قانونگذار عادی واگذار کرده است.
آنچه مسلم است اینکه قانونگذار اساسی اصل نظارت بر عملکرد شوراها را پذیرفته است، لیکن این مطرح است که با توجه به بعد نظارتی دیوان عدالت اداری بر مامورین واحدها وآیین نامههای دولتی و از سویی دیگر استقلال شوراهای محلی از قوای سه گانه؛ دیوان عدالت اداری با چه سازوکارهایی بر عملکرد شوراهای محلی و اعضای آن نظارت دارد.
در خصوص موضوع صلاحیت یا عدم صلاحیت دیوان عدالت اداری برای بررسی و لغو مصوبات شوراهای اسلامی چندین نظریه و دیدگاه حقوقی قابل طرح و تامل است. از جمله عدم صلاحیت دیوان عدالت اداری برای ورود به مصوبات شوراها، صلاحیت دیوان عدالت اداری در رسیدگی به مصوبات شوراها، صلاحیت دیوان عدالت اداری در رسیدگی به مصوبات شوراهای شهر و عدم صلاحیت آن در رسیدگی به مصوبات سایر شوراها، صلاحیت دادگاههای عمومی در رسیدگی به مصوبات شوراها. آنچه به عنوان نتیجه از رویه عملی دیوان عدالت اداری منتج میشود، صلاحیت هیئت عمومی دیوان عدالت در ابطال مصوبات شوراهاست.
با این همه رسیدگی مستقل دیوان به مصوبات شوراها با وجود هیئتهای حل اختلاف به نوعی نقض غرض توسط قانونگذار به شمار میآید. لذا با عنایت به پیشبینی ساز و کار مشخص در جهت ابطال مصوبات توسط قانونگذار و عدم پیشبینی صریح دخالت دیوان در قوانین قبل و حتی اصلاحی دیوان عدالت اداری و قانون شوراها، مسئولیت این نظارت را میبایست متوجة هیئتهای حل اختلاف کرد. مشروط بر اینکه دیوان عدالت اداری مرجع تجدیدنظر و رسیدگی نهایی به کلیه آرای هیئتهای حل اختلاف در نظر گرفته شود؛ چرا که به هر حال هیئتهای حل اختلاف علیرغم ماهیت مستقل و تخصصی خود، جزء کمیسیونهای مستقل اداری و از جمله نهادهای شبه قضایی محسوب میشوند. لیکن رسیدگی در دیوان، رسیدگی در مرجعی قضایی و تخصصی است.
The supervision over the councils has been anticipated in Articles 105 and 106 of the Constitution. However, there is not any specific name of authority or reference for such supervision and monitoring. According to Article 173 of the Constitution, to investigate the complaints, grievances, and objections of the people against governmental officials, units, and protocols, and for the people to restore their rights, a court named the Court of Administrative Justice will be established under the supervision of the head of the judiciary. The law shall determine the responsibility and the mode of operation of this court.
As mentioned, the legislator has confirmed the supervision over the performance of councils. However, the question raised here is about mechanisms that should be used by the Court of Administrative Justice to monitor actions of local councils and their members by considering the regulatory model of the court on governmental officials and protocols as well as the independence of local councils from three powers.
There are several legal theories about the competency of the Court of Administrative Justice for investigation and nullification of approvals of Islamic councils. Some of these theories include lack of jurisdiction of the Court of Administrative Justice to join in councils' ratifications, competency of Court of Administrative Justice for investigation of councils' approvals, competency of Court of Administrative Justice for investigation of city councils' approvals, lack of jurisdiction of this court for investigation of approvals of other councils, and competency of public trials for investigation of other councils' ratifications. Results of the practical procedure of the Court of Administrative Justice confirm the competency of this court for nullification of councils' approvals.
However, the impendent investigation of councils' approvals by the Court of Administrative Justice is a kind of violation of purpose by legislator considering the existence of boards of the settlement of the dispute. Hence, the monitoring responsibility should be assigned to boards of the settlement of dispute due to the certain mechanism of approvals nullification predicted by the legislator, lack of explicit anticipation of the court interference in previous rules, and the amendment of the Court of Administrative Justice and Councils Act. This assignment, however, depends on choosing the Court of Administrative Justice as the appeal or final deciding court for decisions made by boards of the settlement of the dispute. This is because, despite the independent and specialized nature of boards of the settlement of disputes, they are independent administrative commissions and quasi-judicial institutions. Nevertheless, an investigation by the Court of Administrative Justice is a kind of investigation in a judicial and specialized forum.

اگر چه در اصلاحات جدید قانون شوراها، قانونگذار در تبصره 3 ماده 82 (اصلاحی 6/7/1382 و 27/8/1386) مرجع رسیدگی به شكایت فرد یا افراد سلب عضویت شده به وسیلة هیئتهای حل اختلاف را دیوان عدالت اداری معرفی میكند؛ لیكن تبصره مادة 81 (اصلاحی 27/8/1386) در خصوص انحلال شورا كه در پی اقدامات خلاف وظایف مقرر شوراها و یا عملکرد مخالف مصالح عمومی كشور و حیف و میل و تصرف غیر مجاز در اموال وصولی رخ میدهد، دادگاه صالح را به عنوان مرجع شكایت مطرح میکند، بدون آنکه تعریفی از دادگاه صالح ارائه کند؛ لیکن آنچه از واژة دادگاه به ذهن نزدیکتر است، دادگاههای عمومی دادگستری است که عرفاً دادگاه نامیده میشود.
گروهی دیگر نیز به استناد مواد 10و12 قانون دیوان عدالت اداری و تبصره اصلاحی (27/8/86) ماده 81 قانون تشکیلات وظایف و انتخابات شوراهای اسلامی کشور و انتخاب شهرداران (مصوب 75 با اصلاحات و الحاقات بعدی) دادگاههای عمومی را در رسیدگی به مصوبات شورا صالح میدانند، صلاحیت دیوان را صرفا منحصر به تبصره 3 ماده 82 قانون مذکور در شکایت فرد یا افراد سلب عضویت شده به وسیله هیئتهای حل اختلاف میدانند.
