چکیده:
از بدو پیدایش فضای سایبر، همواره نحوه حاکمیت در آن موردچالش بوده است. نخستین دیدگاهی که در انتظامبخشی این فضا موردپذیرش کشورها قرار گرفت، دکترین حاکمیت انحصاری دولتها بود. مطابق این نگرش، صرفاً دولتها دارای صلاحیت و اقتدار لازم برای حاکمیت و قانونگذاری در فضای سایبر میباشند که این امر بهمنزلة انطباق قلمرو سایبری بر مرزهای جغرافیایی کشورهاست. بهتدریج، این نگرش قوت گرفت که باتوجهبه ماهیت سیّال و بدون مرز فضای سایبر و نیز جلوگیری از سیطره تبعیضآمیز کشورهای عموماً غربی، لازم است این فضا از حیطه حاکمیتی دولتها خارج شده و با طرح اصل میراث مشترک بشریت، زمینه برای انتقال حاکمیت در آن از ید مطلق دولتها به مردم فراهم گردد. حامیان این نگرش با طرح تشابهات میان فضای سایبر با دیگر فضاهای بینالمللی، معتقدند اِعمال هرگونه قانون ملّی در فضای سایبر فاقد مشروعیت دموکراتیک در یک شبکه جهانی است. ضمن آنکه تلقی فضای سایبر بهمثابه میراث مشترک بشریت، از اقدامات یکجانبة دولتها جلوگیری نموده و خطر جنگهای سایبری را کاهش میدهد. اگرچه پذیرش این اصل در فضای سایبر، مبتنیبر خلق قواعد حقوقی نوین در قالب پذیرش در معاهدات بینالمللی است. نوشتار پیش رو سعی دارد از رهگذر شیوۀ توصیفی ـ تحلیلی، ضمن بیان نگرشهای حاکمیتی فعلی در فضای سایبر، امکان اِعمال اصل میراث مشترک بشریت بر بخشهای موردنظر در فضای سایبر را تبیین نماید.
Since the advent of cyberspace, the method of governance has always been challenged. The first insight into the regulation of this space that accepted by the states was the doctrine of absolute sovereignty. According to this view, only states have the jurisdiction and necessary authority to govern and legislate in cyberspace and this implies cyber realm is aligned with the geographical boundaries of countries. Gradually, this idea was established that in according to fluid and boundless nature of cyberspace as well as the prevention of discriminatory domination of the generally western countries, this space has to be fallen out of the sovereignty of states and with the principle of common heritage of mankind, the ground for the transfer of sovereignty from absolute authority of states to people should be provided. The supporters of this view, by plotting the similarities between cyberspace and other international spaces, argue that the application of any national law in the cyberspace lacks democratic legitimacy in a global network. Furthermore, the perception of cyberspace as common heritage of mankind prevents governments from unilateral actions and reduces the risks of cyber warfare. Although accepting this principle in the cyberspace is based on the creation of new legal rules in the form of acceptance in the international treaties. The present paper, through a descriptive-analytic method, attempts to express the current sovereignty attitudes and explain the possibility of applying the principle of common heritage of mankind to the areas of interest in cyberspace.

فضای سایبر، میراث مشترک بشریت ، دکترین حاکمیت انحصاری ، فضاهای بین المللی ، قانونگذاری مقدمه پس از سال ١٩٧٢ که اینترنت از انحصار دولت ایالات متحده خارج شد و رفته رفته گسترش یافته و سراسر جهان را دربرگرفت ، این بحث مطرح گردید که مرزهای سایبری نیز به تبع آن دچار تغییر شده اند.
