چکیده:
حق سکوت متهم، جلوهای از حقوق دفاعی وی و در ارتباط مستقیم با اصل نفی خوداتهامی است. این وضعیت در حقوق کیفری ایران و ایالاتمتحده تابع مقتضیات متفاوت است. بررسی رابطه میان حق سکوت و اصل نفی خوداتهامی در حقوق کیفری ایران و رویه قضایی ایالاتمتحده و پیششرط بازداشت متهم و نحوه استناد به آن در محکومیت متهم با در نظر گرفتن ضمانتاجراهای احتمالی آن موضوع این نوشتار است. سؤال اصلی پژوهش این است که رابطه میان اصل نفی خوداتهامی و اعلام حق سکوت به متهم در حقوق کیفری و ضمانت اجرای آن چیست؟ یافتههای پژوهش نشان میدهد اصل نفی خوداتهامی و رعایت حق سکوت متهم دو روی سکه دادرسی عادلانه هستند. رعایت حق سکوت و اصل نفی خوداتهامی در حقوق کیفری ایران با اتکاء به ضمانتاجراهای خود تفکیک و نامتوازن شدهاند، لیکن منوط به هیچ پیششرطی نیستند. رویه قضایی ایالاتمتحده از اصل نفی خوداتهامی مقرر در اصلاحیه پنجم قانون اساسی به حق سکوت تعبیر کرده است و هر دو را بهنحو یکسان تابع ضمانتاجرای بیاعتباری اظهارات اخذشده از متهم قرار داده است، لیکن برای آنها قائل به پیششرط است.
Defendant's right to silence is a guarantee of his defense rights and is in direct connection with the principle of Self-Incrimination. This situation is different by requirements function in criminal law of Iran and United States Jurisprudence. Study of the relationship between the right to silence and the principle of self-incrimination in criminal law of Iran and the United States Jurisprudence, and precondition for the detention of the accused and how it is cited in the conviction of the accused, with regard to possible safeguards, is subject of this article. Main question of this research is what is the relationship between the principle of self-incrimination and the declaration of the right of silence to the accused in criminal law and its safeguard? Findings of this research show that the principle of self-incrimination and the observance of the defendant's right to silence are both parts of fair trial’s coin. Observance of the right to silence and the principle of self-incrimination are separate in Iran's criminal law and non-distorted based on their own, but are not subject to any preconditions. United States Jurisprudence have interpreted the principle of Self-Incrimination as set forth right to silence in the fifth Constitution Amendment, and they are subordinate to same guarantee of insubstantiated statements made by the accused, but believes precondition for them.

اگرچه اشاره اصلي ماده ٥ قانون آيين دادرسي کيفري اطلاع از اتهام و دلايل مؤيد آن است ، ليکن اشاره ذيل آن به بهره مندي متهم از ساير حقوق دفاعي مذکور در قانون آيين دادرسي کيفري اين ابهام را برطرف مي کند که برخورداري متهم از ساير حقوق دفاعي شامل حق سکوت و اصل نفي خوداتهامي با تصريح مقنن بر بي اعتباري اقرار توأم با اجبار و اکراه و لزوم اعلام عبارت «مراقب اظهارات خود باشيد» ولو بدون ضمانت اجرا نيز مي باشد.
اين وضعيت حاکي از پيش بيني ضمانت اجراي يکسان براي دو مفهوم حق سکوت متهم و اصل نفي خوداتهامي است که در حقوق کيفري ايران مفقود است ؛ اما نتيجه گيري رويه قضايي ايالات متحده به پيش شرط بازداشت متهم اين است که بازجويي از متهم در شرايط غير بازداشت منوط به اعلام حق سکوت به وي از سوي پليس نيست .
