چکیده:
توسعه و بهکارگیری سامانههای رباتیک و افزایش استقلال آنها زمینه بهکارگیری این تسلیحات را در مخاصمات مسلحانه فراهم کرده است. در این بین، وسایل بدون سرنشین خودکار، که بدون درنگ و بدون کنترل کاربر انسانی حمله به اهداف را انجام میدهد، در مورد مسئولیت کیفری فرد و رعایت حقوق بینالمللی بشردوستانه نگرانیهای جدی بهوجود آورده است. در همین راستا برخی از سازمانهای غیردولتی، خواستار ممنوعیت کامل توسعه، تولید و استفاده از تسلیحات خودکار هستند. این نوشته با تکیه بر مفهوم کنترل معنیدار انسان و تأکید بر حضور انسان در تمام مراحل، از ایجاد تا بهکارگیری وسیله خودکار در زمان مخاصمه مسلحانه، سعی در حل چالش مسئولیت کیفری داشته است. بنابراین در صورت نقض قواعد بنیادین حقوق بشردوستانه، مسئولیت کیفری فردی و حتی مسئولیت مشترک تمام افراد مرتبط با آنها از قبیل برنامهنویس، طراح، رزمندگان و فرماندهان مطرح میشود. از اینرو بهکارگیری این نوع وسایل بدون کنترل و یا نظارت انسان ممنوع بوده و نمیتوان بهطورکامل نقش فرد را در بهکارگیری وسایل خودکار، انکار کرد. درنهایت مفهوم کنترل معنیدار انسان به برقراری پیوند فرد با این نوع وسایل منجر میشود، که در صورت وقوع نقض قواعد بنیادین حقوق بشردوستانه مسئولیت کیفری فرد مرتبط با این نوع وسایل محرز خواهد بود.
Development and deployment of robotic systems and the increased independence of these systems have led to the deployment of these weapons in armed conflict. Meanwhile, autonomous unmanned vehicles, which carry out attacks on targets without delay and control of the human user, have raised serious concerns about individual criminal responsibility and respect for international humanitarian law. Some of non-governmental organizations therefore call for a ban on the development, production and use of autonomous weapons. The present article has tried to solve the criminal responsibility challenge by relying on the concept of meaningful human control and emphasizing human presence at all stages, from the creation to the use of autonomous means during armed conflict. Thus, in violation of the fundamental rules of humanitarian law, individual criminal responsibility and the joint responsibility of all those involved, such as programmers, designers, warriors and commanders arise. And it is forbidden to use such devices without human supervision. Accordingly, in the use of autonomous means, the role of the individual cannot be completely denied. And the concept of meaningful human control leads to the electrification of the individual's connection to these kinds of devices. And in the event of a breach of the fundamental rules of humanitarian law, the criminal liability of the person concerned with such means shall be established.
