چکیده:
چگونگی توزیع عادلانهی فضای شهر، بگونهای که علاوه بر محفوظ قرار دادن حقوق مالکان خصوصی، حقوق مردم شهر را نیز مورد احترام قرار دهد، از اساسیترین مسائل حقوق معماری و شهرسازی است. پرداختن به این موضوع، متاخر از شناخت ماهیت فضای شهر، و احصاء حقوق مترتب بر آن است؛ که در نوشتار حاضر تلاش شد با ابتنا بر منابع فقهی حقوقی به آن پرداخته شود. طبق نتایج این تحقیق، بر خلاف ماده 38 قانون مدنی و نظر برخی فقهای متقدم، فضای شهر بر اساس مالکیت زمین تحتانی آن به سه بخش عمده تقسیم میشود: «الف. فضای عمومی شهر، که از دوقسمت فضای محاذ بر معابر عمومی و فضای محاذ بر املاک خصوصی، فراتر از حد متعارف ارتفاع، تشکیل میشود. ب. فضای اختصاصی، فضای محاذ بر املاک خصوصی، ذیل حد متعارف ارتفاع، که در پشت فضای اشتراکی قرار دارد. ج. فضای اشتراکی، فضای محاذ بر املاک خصوصی، ذیل حد متعارف ارتفاع، که در مجاورت با فضاهای عمومی شهر قرار دارد». سنخ اول فضاهای مزبور، در زمره اموال عمومی و از مصادیق مشترکات عمومی و طبعا در مالکیت عموم محسوب میشود. سنخ دوم، از زمره اموال خصوصی و در مالکیت خصوصی زمین تحت آن قرار دارد، و مردم نسبت به آن حق ارتفاق دارند. و سنخ سوم فضای مزبور نیز در زمره اموال مشاء است که مردم نسبت به آن حق اشتراک دارند. این تلقی از ماهیت فضای شهر میتواند در بازخوانی مبانی برنامهریزی شهری، در راستای تسهیل تحققپذیری حقوق شهروندان تاثیر گذار باشد.
