چکیده:
تا پیش از پیدایش شورای قانون اساسی، ساختار دادگاههای فرانسوی دوگانه بود؛ یعنی برخی دعاوی در دادگاههای قضایی رسیدگی میشدند و برخی دیگر در دادگاههای اداری. بر پایه بخش هفتم قانون اساسی 1958 (ماده 56 تا 63) دادگاهی پایهگذاری شد که کارویژههای مهمی از دادرسی اساسی (سازگاری قانون عادی و ساختاری با قانون اساسی) تا دادرسی انتخاباتی (رسیدگی به دعاوی انتخاباتی) را انجام میداد، اما در دستهبندی دادگاه اداری یا قضایی جای نمیگرفت. با آنکه در آغاز شیوه نگارش و ساختار آرای شورا نزدیک به شورای دولتی بود، اندکاندک کوتاهنویسی کنار گذاشته شد و بر استدلال در آرا افزوده شد. با گذشت زمان، پافشاری بخشی از آموزه حقوقی از یک سو (بهدلیل کارویژه این نهاد در حفظ نظم حقوق اساسی و پشتیبانی از حقوق و آزادیهای بنیادین) و نظارت شهروندان بر عملکردش از سوی دیگر، سبب شد تا شورا در سال 2016 با هدف استدلال بیشتر و فهمپذیری بهتر، شیوه نگارش و ساختار آرای خود را بازبینی کند. در این پژوهش تحلیلی-انتقادی، با بررسی کارنامه شورا در زمینه سازگاری قوانین با قانون اساسی، خواهیم دید که کامیابیهای بهدستآمده هنوز چالشهای پیش روی این نهاد در دستیابی به آن هدفها پایان نیافتهاند.
Prior to the creation of the constitutional Council, the structure of the French courts was twofold, with some cases being heard in judicial courts and others in administrative courts. Under the Seventh Section of the 1958 Constitution (Articles 56 to 63), a court was established that performed important functions from the constitutional justice (compatibility of the ordinary and organic law with the Constitution) to the electoral justice (adjudication of electoral claims). However, it did not fall into the category of administrative or judicial courts. Although at the beginning the style of writing and structuring the decisions of the council was close to that of the Supreme administrative court, over time it abandoned concision and added reasoning to the decisions. Apart from insisting on a part of the legal doctrine, on the one hand, due to the special function of this institution in maintaining the legal-constitutional order and also supporting fundamental rights and freedoms and on the other hand, democratic control over its performance, the council decided in 2016 to review the writing method and the structure of its decisions, with the aim of further reasoning and better comprehensibility. In this study, by examining the balance of the council in the field of conformity of ordinary legislation with the constitution, we will examine the successes and challenges facing this institution in achieving those goals.

Il s’agit là d’un choix de rédaction pérenne, qui a vocation à être décliné pour l’ensemble des types de décisions que rendra désormais le Conseil constitutionnel, tant dans l’objectif de renforcer l’intelligibilité et la lisibilité de ses décisions qu’afin de permettre une motivation plus approfondie de celles- ci ».
Considérant, d'une part, qu'aux termes de l'article 62 in fine de la Constitution : « les décisions du Conseil constitutionnel s'imposent aux pouvoirs publics et à toutes les autorités administratives et juridictionnelles » ; que l'autorité des décisions visées par cette disposition s'attache non seulement à leur dispositif mais aussi aux motifs qui en sont le soutien nécessaire et en constituent le fondement même ».
