چکیده:
زمینه و هدف: سیاست جنایی و بهطور ویژه سیاست جنایی مشارکتی، در صدد است تا با بهکارگیری تمام ظرفیتهای موجود از ارتکاب بزهکاری توسط کودکان کار و خیابان جلوگیری کرده و فعالیتهای خود را از سطح فرهنگسازی و تدوین قوانین تا اجرای عادلانه احکام قضایی و کیفری در رابطه با کودکان و نوجوانان مرتکب بزه در پیش گیرد. پژوهش حاضر باهدف واکاوی قوانین موجود، بررسی ظرفیت نهادهای دولتی و غیردولتی و بهدنبال دستیابی به پاسخ سیاست جنایی ایران در پیشگیری از بزهکاری کودکان کار و خیابانی انجام شد. روش: پژوهش حاضر ازنظر هدف کاربردی و ازنظر روش توصیفی – تحلیلی است که دادههای آن به روش کتابخانهای از اسناد و قوانین و مقررات مرتبط جمعآوری شد. یافتهها و نتایج:. برای پیشگیری کردن از بزهکاری کودکان کار، در کنار پاسخهای تقنینی و قضایی، باید بهدنبال حذف عوامل بزه در میان کودکان بود. بزرگترین مشکل در مسیر کودکان، مشکلات اقتصادی و پیرو آن محرومیت از تحصیل و رویآوردن به کار خیابانی است. مهمترین پاسخهای سیاست جنایی در عرصه غیرکیفری، ایجاد شرایطی برای تربیت و جامعهپذیری کودکان کار بزهکار است که در صورت روی آوردن به بزه و اعمال مجرمانه از ارتکاب مجدد به جرم خودداری کنند و به بیان بهتر، منفعتی در ارتکاب به جرم کسب نکنند.
Background and Aim: Criminal policy, and in particular participatory criminal policy, seeks to use all available capacities to prevent delinquency committed by working and street children and their activities from the level of culture and law-making to the fair implementation of judicial and criminal sentences in relation to children and adolescents who commit crimes. The present study was conducted with the aim of analyzing the existing laws, examining the capacity of governmental and non-governmental institutions and seeking to achieve a response to Iran's criminal policy in preventing delinquency of working and street children.Method: The present study is applied in terms of purpose and descriptive-analytical in terms of method. Data were collected by a library of documents and considering the related laws and regulations.Results and Conclusion: In order to prevent delinquency of working children, in addition to legislative and judicial responses, the elimination of the causes of delinquency among children should be sought. The biggest problem in the path of children is economic problems and the consequent deprivation of education and turning to street work. The most important answers of criminal policy in the non-criminal field are to create conditions for the upbringing and socialization of delinquent working children who, if they turn to crime and criminal acts, refrain from committing a crime and, to put it better, do not benefit from committing a crime.
