چکیده:
یکی از مسائل مهم و مستحدثه فقهی بررسی حکم معذوران جسمی است؛ مسلوس و مبطونشدن، یکی از معلولیتهایی است که به موجب آن شخص قادر به حبس بول یا مدفوع خود نیست. این اشخاص برای انجام برخی عبادات همچون نماز، طوافو نماز طواف دچار مشکل میشوند که در این مقاله تلاششده حکم فقهی اعمال ایشان با توجه به ادله مشخص شود. از آنجا که معذوران انواع مختلفی دارند، بالتبع احکام متفاوتی نیز دارند که پس از بررسی سندی و دلالی روایات، این احکام روشن میگردد. در مورد حکم طواف هم هر چند برخی افزون بر انجام طواف توسط فرد معذور، به لزوم نایبگرفتن نیز فتوا دادهاند اما مقتضای ادله آن است که نیابت لازم نیستو در مورد حکم نماز طواف و لزوم تحصیل طهارت جدید نیز بین فقها اختلاف وجود دارد که هرچند احتیاط در تجدید وضوست، اما نتیجه بررسی ادله عدم لزوم آن است.
The study of the rulings of the worship acts that physically-excused pilgrims of Hajj and Umrah perform is one of the major and innovative jurisprudential concerns. Being mabtun or maslus describes a condition in which man cannot control his urine or feces. Some acts of worship in Hajj and Umrah such as prayer, Tawaf, and Tawaf prayer are difficult for these excused people to perform. This article will use evidence to determine the jurisprudential rulings of these pilgrims’ worship acts. Since the excused pilgrims’ justifications vary, they are subjected to distinct rulings, which will be discussed here following the documentary and logical evaluation of the narrations. Regarding the ruling on Tawaf, while, some issue fatwas on the necessity of hiring an agent to perform Tawaf on behalf of the excused pilgrim besides his own performance, the evidence finds this agency unnecessary. Also, with regards to Tawaf prayer and the necessity of renewing ablution, jurisprudents provide different ideas; despite the precaution of renewing ablution, examining the evidence finds it unnecessary.
