چکیده:
بیگمان همۀ فقهای مذاهب اسلامی اعمال حقوقی و تصرفات مجنون ادواری را در حالت جنون بیاثر و در حالت افاقه صحیح میدانند، اما گاهی از مجنون ادواری عمل حقوقی سرمیزند و مشخص نیست آن عمل در زمان افاقه سرزدهاست یا در زمان جنون بودهاست. فقیهان مذاهب مختلف و همچنین حقوقدانان در تعیین حکم این فرع فقهی دچار اختلاف شدهاند. با توجه به اینکه در ادلۀ لفظی اشارۀ صریحی به این فرع فقهی نشدهاست، برخی از اصولیان که تمسک به عام در شبهۀ مصداقیه را جایز میدانند، به عموم و اطلاق «أوفوا بالعقود» یا «أحل الله البیع» تمسک کردهاند و عقد را نافذ دانستهاند. اما از آنجا که مطابق نظر مشهورِ اصولیان تمسک به عام در شبهات مصداقیه جایز نیست، برخی با تمسک به «اصل استصحاب» و «اصل برائت» معامله را باطل دانستهاند و گروهی با استناد به «اصل صحت» به صحت این معامله حکم کردهاند. نویسندگان در این نوشتار پس از نقل اقوال و نقد ادلۀ هریک از اقوال، با توجه به اتقان ادلۀ فقهایی که این معامله را صحیح دانستهاند، به صحت چنین معاملهای باورمند هستند.

Jurists of different religions as well as jurists have disagreed in ruling this jurisprudence. Since there is no explicit reference to this jurisprudence in the literal argument; Some of the principles that allow for public reverence in the face of misogyny, They have called upon the public of 'Ufa Baqqud' or 'Ahlullah al-Bai' and have considered the contract to be valid; But since it is not permissible to question the generality of the facts in the substance of the matter, according to the well-known principle of the Principles, Some have called the transaction null and void, relying on the "principle of quotation" and "the principle of absurdity," and some have ruled that the transaction was valid.
