چکیده:
در گذشته نه چندان دور این اعتقاد وجود داشت که نظام حقوقی بر خلاف خسارتهای فیزیکی قادر به اندازه گیری رنج روحی یا اضطراب درونی نیست و بنابراین این قبیل خسارات قابل جبران نمی باشد. دادگاهها در مورد پرونده هایی که منجر به آسیبهای عاطفی بدون ایجاد صدمات فیزیکی گردیده بودند تمایلی به صدورحکم جبران خسارت نداشتند. در آن زمان علم پزشکی روانشناسی نمی توانست رابطه بین ایجاد آسیبهای عاطفی و علل فیزیکی منجر به آنها را اثبات نماید .. برای مدتها اکثر مردم اعتقاد داشتند که جنون و دیگر بیماریهای روانی در نتیجه گناهان شخص ایجاد می گردد. در دوران معاصر چنین باوری تغییر اساسی کرده و مطالعات روان، بخش جدایی ناپذیری از علم پزشکی گردیده است. متناسب با این تغییر حقوق نیز به مرور این واقعیت را پذیرفته که آسیبهای روانی نیز همانند آسیبهای فیزیکی واقعی هستند و می توانند ناشی از اعمال فیزیکی باشند. البته این بدان معنا نیست که حقوق هر گونه خسارت معنوی را پذیرفته و حکم به جبران آن می دهد. یکی از موارد قابل تامل زمانی است که شخص دچار آسیبهای روانی گردیده ولی این آسیب ناشی از صدمات فیزیکی وارد شده به وی نمی باشد بلکه در نتیجه دیدن یا شنیدن خبرجراحات وارد به شخص دیگری دچار آسیب روانی می گردد. مثال کلاسیک آن زمانی است که یک مادر شاهد به زیر گرفته شدن فرزندش توسط یک راننده بی احتیاط می باشد . چنین مادری احتمالاً دچار آسیب روانی گردیده وقادر نخواهد بود وظایف روزمره خود را به درستی انجام دهد. آیا چنین مادری می تواند به دلیل چنین آسیبهای روانی اقامه دعوا نموده و مطالبه خسارت نماید.

Of course, this does not mean that the rights accept any moral damage and order to compensate it. One of the cases to consider is when a person suffers mental injuries, but this injury is not caused by physical injuries inflicted on him, but as a result of seeing or hearing the news of injuries inflicted on another person, he suffers psychological injuries. The classic example is when a mother witnesses her child being run over by a careless driver. Such a mother is probably psychologically damaged and will not be able to perform her daily tasks properly. Can such a mother file a lawsuit and claim damages due to such mental injuries?
