چکیده:
زمینه و هدف: جرائم اقتصادی بهدلیل آثار مهم اقتصادی و اجتماعی همواره محل بحث و نظر بوده است. در این مقاله تلاش شده به بررسی جرائم اقتصادی در فقه، قوانین ایران و اسناد اروپایی پرداخته شود. مواد و روشها: مقاله توصیفی تحلیلی بوده و با استفاده از روش کتابخانهای به بررسی سؤال مورداشاره پرداخته است. ملاحظات اخلاقی: در این مقاله، اصالت متون، صداقت و امانتداری رعایت شده است. یافتهها: رویکرد فقه نسبت به جرائم اقتصادی بر اساس «اَکْلُ مَالٍ بِهِ بَاطِلٌ» و «اُکْلُ سُحْتٍ» قابل تبیین است. اَکْلُ مَالٍ بِهِ بَاطِلٌ هرگونه تجاوز به حقوق و تصرف در اموال دیگران، اموال عمومی و انفال و حتی تصرفات ناروا و غیرمشروع در اموال خویش و نیز کارهایی از قبیل ربا، رشوه، را در برمیگیرد. مطابق اصل اول سُحْتٍ نیز اموالی که انسان به ناحق و از راههای حرام و باطل، به چنگ میآورد، (سُحت) است. در قوانین ایران نیز با اینکه قانونگذار مواردی را تحت عنوان جرائم اقتصادی احصاء کرده است اما این اقدام قانونگذار بخش مهمی از جرائم اقتصادی را نادیده گرفته است. در اسناد اروپایی نیز بر جرائم سازمانیافته اقتصادی مانند پولشویی و قاچاق کلاً تمرکز شده است. نتیجهگیری: مصادیق جرائم اقتصادی در فقه، قوانین ایران و اسناد اروپایی یکسان نیست اما هم در فقه، هم در قوانین و هم در اسناد اروپایی، نامشروع بودن و ممانعت از برهم زدن نظم و تعادل اقتصادی مهمترین مبنای جرمانگاری جرائم اقتصادی است.
Background and Aim: Economic crimes have always been discussed due to their important economic and social effects. This article tries to study economic crimes in jurisprudence, Iranian law and European documents. Materials and Methods: This is a descriptive-analytical article using the library method to examine the question in question. Ethical considerations: In this article, the originality of the texts, honesty and trustworthiness have been observed. Findings: The jurisprudential approach to economic crimes can be explained on the basis of “Eating worthless money” and “Eating unlawful things”. Eating worthless money includes any encroachment on the rights and property of others and any unlawful seizure of one's own property, such as usury and bribery. According to “Eating unlawful things”, whatever one acquires by false and illegitimate methods is slander. In Iranian law, although the legislature has included cases under the heading of economic crimes. European documents also focus on organized economic crimes such as money laundering and trafficking in general. Conclusion: The cases of economic crimes in jurisprudence, Iranian law and European documents are not the same, but in jurisprudence, laws and European documents, illegitimacy and prevention of disturbing the economic order and balance is the most important basis for criminalizing economic crimes.
