چکیده:
زمینه و هدف: در معاملات ارادی مانند بیع و اجاره رعایت موازنه در حقوق قراردادی طرفین عقد معاوضی یا هر عقد دیگری که موازنه حقوق از انگیزههای طرفین عقد است؛ خواه عقد معاوضی باشد یا نباشد، اقتضای این دارد که حقوق طرفین قراردادها مانند دو کفه ترازو باهم برابری نمایند. قاعده موازنه یا عدالت معاوضی مربوط به حوزه حقوق خصوصی و نازل به روابط بین مردم بوده و شامل لزوم برقراری موازنه و تعادل در ضمانات قهری (الزامات خارج از قرارداد) و موازنه در عقود معاوضی میباشد. بر این اساس در این مقاله به این امر میپردازیم که عدالت معاوضی در عقود معاوضی در حقوق ایران و مصر از چه جایگاهی برخوردار است؟
روش: پژوهش حاضر با روش توصیفی - تحلیلی انجامشده است.
یافتهها و نتایج: نتایج تحقیق نشان داد که، در سیستم حقوق دو کشور ایران و مصر، عدالت معاوضهای در مصادیقی چون؛ حق حبس، قاعده تلف مبیع قبل از قبض و خیارات قانونی، بروز میابد و بهعنوان توجیهکننده و دلایل این نظریه در نظر گرفته شدند. قانون مدنی ایران این قانون را بهصورت ضمنی مورد پوشش قرار داده است و در حقوق مصر، عدالت معاوضهای در عقود معاوضهای بهصورت واضح و آشکار بیانشدهاند.
Field and Aims: In voluntary transactions such as sale and lease, the balance in the contractual rights of the parties to the exchange contract or any other contract where the balance of rights is one of the motivations of the parties to the contract; Whether it is a exchange contract or not, it is necessary that the rights of the parties to the contracts are equal, like two sides of a scale. The rule of balance or exchange justice is related to the field of private law and relates to relations between people and includes the need to establish balance in civil responsibility (extera contract) and balance in exchange contracts. Based on this, in this article, we are going to discuss what is the position of commutative justice in exchange contract in the laws of Iran and Egypt.
Method: The present research was carried out with a descriptive analytical method.
Finding and Conclusion: The results of the research showed that, in the legal system of the two countries of Iran and Egypt, the commutative justice in cases such as; The right to imprisonment, the rule of distraction of the sold befor delivery and legal options appear and were considered as justifications and reasons for this theory.Iran's civil law has implicitly covered this law. and in Egyptian law, commutative exchange are clearly stated in exchange contracts.
