چکیده:
زمینه و هدف: قرار داشتن تأسیسات نفتی ثابت واقع در منطقه فلات قاره در خارج از قلمرو حاکمیت دولت ساحلی، محدودیتهایی را در زمینه حمایت کیفری از آنها ایجاد مینماید. در این مقاله با بهرهگیری از اسناد بینالمللی و قواعد مربوط به اجرای برونمرزی قوانین کیفری، ظرفیتهای حقوق داخلی در زمینه حمایت کیفری از این تأسیسات مورد بررسی قرار گرفته است. بر این اساس به بررسی این امر میپردازیم که در مقررات چه حمایت کیفری از سکوهای نفتی ثابت واقع در منطقه فلات قاره انجام گرفته است؟روش: پژوهش حاضر به روش توصیفی - تحلیلی انجام شده است.یافتهها و نتایج: اگرچه عرف بینالملل، سازوکارهای لازم را جهت اعمال صلاحیت کیفری بر این تأسیسات در قالب پروتکل موسوم به مقابله با اعمال غیرقانونی علیه امنیت سکوهای نفتی ثابت در منطقه فلات قاره الحاقی به کنوانسیون مقابله با اعمال غیرقانونی علیه ایمنی دریانوردی مصوب 1988 رم پیشبینی نموده اما بهرغم پیوستن کشورمان به این پروتکل و تأکید آن به مقابله کیفری با اعمال مندرج در پروتکل از سوی کشورهای عضو، هیچگونه اقدامی در خصوص جرمانگاری این اقدامات در حقوق کیفری ما صورت نگرفته و امکان استفاده از ظرفیت آن در حمایت کیفری از این تأسیسات سلب گردیده است. همچنین به دلیل عدم پیشبینی این تأسیسات در مصادیق صلاحیت واقعی اعمال قانون مجازات اسلامی و نبود قانون خاص دیگر در این زمینه، در حال حاضر حقوق کیفری ما در زمینه حمایت از این تأسیسات با خلأ قانونی روبروست و صرفاً با توسل به عمومات قانونی میتوان از آنها حمایت نمود.
Field and Aims: The location of fixed oil facilities located in the continental shelf area outside the territorial jurisdiction of the coastal state creates limitations in the field of criminal protection for them. In this article, by using international documents and rules related to the cross-border implementation of criminal laws, the capacities of domestic laws in the field of criminal protection of these facilities have been examined. Based on this, we are going to investigate what criminal protection has been done in the regulations of the fixed oil platforms located in the continental shelf area?
Method: The present research was carried out using a descriptive-analytical method.
Finding and Conclusion: Although the international custom has established the necessary mechanisms to apply criminal jurisdiction over these facilities in the form of the so-called Protocol to Combat Illegal Acts against the Safety of Fixed Oil Platforms in the Continental Shelf Region, an addendum to the Convention against Illegal Acts against Maritime Safety approved by Rome in 1988, but despite our country's accession to this protocol and its emphasis on criminal countermeasures against the act contained in the protocol by the member countries, no action has been taken regarding the criminalization of these acts in our criminal law and the possibility of using Its capacity in criminal protection has been taken away from this facility. Also, due to the lack of provision for these facilities in the cases of the actual jurisdiction of applying the Islamic Penal Code and the absence of any other specific law in this field, currently our criminal law in the field of protecting these facilities is facing a legal gap and only by resorting to legal generality.
