چکیده:
زمینه و هدف: در فقه اسلامی تصریحی در مورد مسئولیت کیفری دولت به عنوان شخص حقوقی وجود ندارد و صرفاً در آثار برخی فقهای عظام مباحثی در باب اثبات شخصیت حقوقی نهادهایی همچون وقف، بیتالمال و دولت ذکر شده است؛ لکن با استفاده از منطق استنباط، میتوان دلایل متقنی با پشتوانه فقهی مستحکم برای این موضوع ارائه نمود. نگارندگان در این مقاله در پی پاسخگویی به این مسأله هستند که انتصاب مسئولیت کیفری به دولتها بر کدام مبانی فقهی استوار است؟روش: پژوهش حاضر به روش توصیفی- تحلیلی انجام شده است.یافتهها و نتایج: نگارندگان ضمن گونهشناسی جرایم دولتی و بیان پذیرش شخصیت حقوقی دولت در فقه اسلامی و همچنین پذیرش قابلیت انتساب مسئولیت کیفری به دولتها، به مبانی فقهی عام نظیر کتاب و سنت و مبانی فقهی خاص شامل قاعده التّعزیر لکلّ عملٍ محرّمٍ، عاقلۀ الامام، قائم مقامی دولت، قاعده مصلحت، قاعده لایُبطل دمُ امرءٍ مسلم، مسئولیت ناشی از رفتارشخص غیر، قاعده حفظ نظام، عدالت کیفری و در نهایت سیره عقلا پرداختهاند و نتایج پژوهش مؤید این مطلب هستند که مسئولیت کیفری دولتها-که در تحولات قوانین کیفری بعد از سال 1392 تقنین شدهاند- از منظر فقه اسلامی نیز دارای اعتبار و مشروعیت است.
Field and Aims: In Islamic jurisprudence, there is no clarification about the criminal responsibility of the government as a legal entity, and only in the works of some great jurists, discussions about proving the legal personality of institutions such as religious endowment, beit_ul_mal and the government have been mentioned. However, by using the logic of inference, it is possible to provide valid reasons with a strong jurisprudential support for this issue. In this article, the authors are trying to answer the question that the assignment of criminal responsibility to the governments is based on which jurisprudential foundations?
Method: The present research was carried out using a descriptive analytical method.
Finding and Conclusion: The authors, in addition to the typology of state crimes and expressing the acceptance of the legal personality of the state in Islamic jurisprudence, as well as the acceptance of the possibility of assigning criminal responsibility to governments, based on general jurisprudential foundations such as the holy Quran and tradition and special jurisprudential foundations, including the rule of al-Tazir for all prohibited acts, the AGHEL_AL_EMAM. , the viceroy of the government, the rule of expediency, the irrevocable rule of certain things, the responsibility caused by the behavior of another person, the rule of maintaining the system, criminal justice and finally the rational way, and the results of the research confirm the fact that the criminal responsibility of the governments, which in the evolution of the criminal laws later They have been legislated since 2012 and are valid and legitimate from the point of view of Islamic jurisprudence.
