چکیده:
از زمان تصویب کنوانسیون پناهندگان به سال 1951، توسعه حقوق بینالمللی پناهندگان با چالشها و موانع سیاسی و حقوقی زیادی مواجه بوده است. این چالشها بهویژه در مناطق مرزی اروپا به دلیل میزان زیاد مهاجرت و پناهندگی بیشتر مشهود بوده است. هدف از این تحقیق، شناسایی و بررسی چالشهای حقوقی و سیاسی فراروی توسعه حقوق بینالمللی پناهندگی در مرزهای اروپا میباشد. این تحقیق ازنظر هدف، کاربردی و ازنظر روش، توصیفی است. پژوهش حاضر با استفاده از منابع کتابخانهای، اینترنتی، مقالات، پژوهشهای لاتین و فارسی و مطالعه قوانین و رویههای حقوق بینالملل درباره حقوق بینالمللی پناهندگان انجامشده است. روش گردآوری اطلاعات، بهصورت فیشبرداری است. یافتههای این پژوهش نشان میدهد که پناهندگان هنوز به حمایتهای بینالمللی مندرج در کنوانسیون 1951 و پروتکل 1967 دسترسی کافی ندارند و لذا شاهد از بین رفتن زندگی میلیونها آواره و پناهنده بهویژه در اروپا هستیم، چراکه این قاره بیشتر از دیگر قارهها میزبان انسانهایی بوده که براثر پدیدههای خشونت، جنگ، ترس از شکنجه و سیاستهای تهاجمی دولتها، مهاجرت و پناهندگی را ترجیح دادهاند. بهرغم چالشها و موانع توسعه حقوق بینالمللی پناهندگان مرزی در اروپا، رویههای قضایی دادگاه اروپایی حقوق بشر حکایت از سیر روند تکاملی این حقوق دارد. همچنین دولتها در قبال پناهندگان، مسئولیت بینالمللی دارند و نمیتوانند از این مسئولیت شانه خالی کنند.
Since the ratification of the Refugee Convention in 1951, the development of international refugee rights has faced many political and legal challenges and obstacles. These challenges have been especially evident in the border areas of Europe due to the high level of migration and asylum. The purpose of this research is to identify and examine the legal and political challenges facing the development of international asylum rights in the borders of Europe. This research is applied in terms of purpose and descriptive in terms of method. The current research has been done by using the library, the internet, articles, Latin and Persian research and studying the laws and procedures of international law about the international rights of refugees. The method of collecting information is in the form of a flash drive. The findings of this research show that refugees still do not have enough access to the international support contained in the 1951 Convention and the 1967 Protocol, and therefore we are witnessing the loss of the lives of millions of displaced persons and refugees, especially in Europe because this continent has hosted more people than other continents who have been affected by natural disasters. Violence, war, fear of torture and aggressive policies of governments have preferred immigration and asylum. Despite the challenges and obstacles to the development of the international rights of border refugees in Europe, the judicial procedures of the European Court of Human Rights indicate the evolution of these rights. Also, governments have an international responsibility towards refugees and cannot shirk from this responsibility.
