چکیده:
افترا یا انتساب ناروای رفتاری مجرمانه به دیگران، گاه شرافت و آبرو و گاهی اعتبار اجتماعی اشخاص را نشانه میگیرد؛ از اینرو حقوق کیفری، اشخاصی که آبرو و شهرت آنان مورد هجمه قرار گرفته است را تحت حمایت خود قرار داده و با تعقیب و مجازات مفتریان سعی میکند تعادل و آرامش ازدسترفته را به جامعه بازگرداند. پیشینه جرمانگاری افترا در حقوق اسلامی به صدر اسلام برمیگردد و افترای جنسی تحت عنوان رمی یا قذف، رفتاری مذموم و قابل مجازات بهشمار آمده است (نور، 4 و 23). اگرچه بهلحاظ محتوا و ماهیتِ آیات مذکور، به نظر میرسد منظور از محصنات، زنان پاکدامن و لزوماً زنده باشند، اما در سنوات اخیر قانونگذار به دفاع از آبرو و شهرت مردگان برخاسته و قذف علیه میت را بسان افترای جنسی زندهها، موجبی برای مجازات حدی محسوب نموده است (ماده 245ق.م.ا). صرفنظر از موارد سقوط حد قذف بهواسطه اثبات، تصدیق، لعان یا گذشتِ مقذوف که دستکم در سه حالتِ آخر میت نمیتواند ایفای نقش نماید و از این حیث ادعایِ احتمالی قاذف مبنی بر حقانیت او در ایرادِ افترا قابل رد یا اثبات نیست، باوجود غلبه جنبه خصوصی و حقالناسیِ این جرم و نیز عدم اهلیّت میت در استیفاء حق بر اساس مبانی فقهی و قانون مدنی، مطرحنمودن چنین جرمی اساساً دارای ایراد و اشکال است. در این نوشتار مبانی و مستندات فقهی و حقوقی تعمیم قذف به دنیای مردگان، غلبه جنبه خصوصی آن و مکانیسم توریث حق قذف به بازماندگانِ میت در آراء اندیشهورزان شیعه و اهلسنت را به روش توصیفی ژرفانگر تحلیل میکنیم.
Defamation or improper attribution of criminal behavior to others sometimes targets the honor and reputation and sometimes the social credibility of individuals; Therefore, the criminal law protects the people whose honor and reputation have been attacked and tries to restore the lost balance and peace to the society by prosecuting and punishing the slanderers. The background of criminalization of defamation in Islamic law goes back to the beginning of Islam, and sexual defamation under the title of Rami or Ghazf is a reprehensible and punishable behavior (Noor, 4 and 23). Although according to the content and nature of the mentioned verses, it seems that Mahshanat refers to chaste and necessarily living women, but in recent years, the legislator has risen up to defend the honor and reputation of the dead and considered defamation against the dead as sexual defamation of the living, as a cause for punishment. has done (Article 245 of the Civil Code). Irrespective of the cases where the limit of qadhaf falls due to the proof, confirmation, curse or forgiveness of the qadhaf, which at least in the last three cases, the dead person cannot play a role, and as such, the possible claim of the qadhaf that he is right in defamation cannot be rejected or proved, despite the preponderance of the private aspect. And the legality of this crime, as well as the ineligibility of the dead person to claim the right based on jurisprudence and civil law, raising such a crime is fundamentally flawed. In this article, we analyze the foundations and jurisprudential and legal documents of generalizing Qazf to the world of the dead, the dominance of its private aspect and the mechanism of inheritance of the right to Qazf to the survivors of the dead in the opinions of Shia and Sunni thinkers in a deep descriptive way.
