چکیده:
یکی از پایههای اساسی رفاه و آسایش مردم امنیت داخلی و خارجی کشور است. بقاء و دوام و اقتدار هر دولتی وابسته به مسائل امنیتی آن کشور است. متولیان امنیت داخلی و خارجی کشور نیروهای نظامی و انتظامی هستند، و اگر رفتار مجرمانه از آنان صادر شود که مخل نظم و امنیت باشد از اهمیت ویژهای برخوردار است. بنابراین بررسی جرائم امنیتی و مجازات آن از نظر فقهی و حقوقی در نیروهای مسلح با درنظر گرفتن جایگاه اجتماعی، آنان در نظام اسلامی از اهمیت ویژهای برخوردار است. قوانین کیفری نیروهای مسلح، در طول تاریخ کراراً مورد بررسی و اصلاح قرار گرفته است، اما جرائم امنیتی آنان از قبیل جاسوسی با توجه به مبانی فقهی و حقوقی کمتر مورد پژوهش واقع شده است. این امر میتواند در جهت پیشگیری از وقوع جرم و یا کاهش آن در نیروهای مسلح به منظور سلامت آنها و آرامش جامعه مفید و مؤثر باشد. در این مقاله جرایم خاص امنیتی نظامی و انتظامی با روی کرد جرم جاسوسی بررسی شده و آیات، و روایات پیشوایان معصوم علیهم السلام مورد استناد قرار گرفته است.
One of the basic foundations of people's well-being and comfort is the internal and external security of the country. The survival, durability and authority of any government depends on the security issues of that country. The custodians of the country's internal and external security are the military and law enforcement forces, and if criminal behavior is issued from them that disrupts order and security, it is of particular importance. Therefore, investigating security crimes and their punishment from the point of view of jurisprudence and law in the armed forces, considering their social position in the Islamic system, is of particular importance. The criminal laws of the armed forces have been repeatedly reviewed and amended throughout history, but their security crimes such as espionage have been less researched due to legal and jurisprudential foundations. This can be useful and effective in preventing crime or reducing it in the armed forces for the sake of their health and the peace of society. In this article, special military and police security crimes are examined with a Kurdish approach to the crime of espionage, and the verses and traditions of the innocent leaders, peace be upon them, are cited.
