چکیده:
از دیر باز بشر به دنبال وضع قوانینی برای کم کردن آسیب های منازعات مسلحانه بخصوص بر غیر نظامیان میبوده. در دنیای مدرن این اصول در قالب قوانین «حقوق بشر دوستانه بین المللی» و یا « حقوق جنگ» در کنوانسیون های مختلف به تصویب رسید که مهمترین آن کنواسیون چهار گانه ژنو 1949 م میباشد. بخشی از این قوانین مربوط به حفاظت از زنان ، کودکان و غیر نظامیان میباشد. در این تحقیق در صدد بررسی مساله حفاظت از جان غیر نظامیان بخصوص کودکان و زنان در منازعات مسلحانه از منظر متون مقدس اسلام و مسیحیت و همچنین دیدگاه های الهی دانانی مسلمان و مسیحی میباشیم. هدف از این پژوهش نشان دادن این مساله است که قوانین مدرن حقوق بشر دوستانه تا چه میزان ریشه در متون مقدس اسلام یا مسیحیت دارد. روش پژوهش در این تحقیق مبتنی بر روش کتابخانه ای و بررسی متون مقدس و الهیایت دو دین اسلام و مسیحیت میباشد. مبتنی بر نتایج این تحقیق گرچه در متون مقدس اسلام و مسیحیت بخصوص در عهد عتیق تفاوت چشمگیری در خصوص رعایت حقوق غیر نظامیان دیده میشود ولی این تفاوت در فتوای الهی دانان مسلمان و مسیحی کمتر میشود.
Humanity has been looking for laws to reduce the harm of armed conflicts, especially on civilians. In the modern world, these principles were approved in the form of "international humanitarian law" or "law of war" in various conventions, the most important of which is the 1949 Geneva Quadrilateral Convention. Part of these laws are related to the protection of women, children and civilians. In this research, we aim to investigate the issue of protecting the lives of civilians, especially children and women, in armed conflicts from the perspective of the holy texts of Islam and Christianity, as well as the views of Muslim and Christian theologians. The purpose of this research is to show how much the modern laws of humanitarian law are rooted in the holy texts of Islam or Christianity. The research method in this research is based on the library method and the study of sacred texts and theology of two religions, Islam and Christianity.Based on the results of this research, although in the holy texts of Islam and Christianity, especially in the Old Testament, there is a significant difference regarding the observance of the rights of civilians, but this difference is less in the fatwas of Muslim and Christian scholars.
