چکیده:
اصناف در حوزهی بازار بهگونهای در تحولات شبکههای تولید و توزیع نقش ایفا میکنند، که میتوان از آنها به عنوان نهادی تنظیم گر در عرصهی فعالیتهای اقتصادی نام برد. لیکن در این میان دولتها با توجه به سیاستهای اتخاذی متفاوت، گاه محدودهی فعالیت اصناف را محدود و با مداخله در جامعهی مدنی آنها، فعالیت آزاد اقتصادیشان را تحت نظارت و کنترل قرار میدهند وگاه خود را از دخالت در سیاستگذاریهای آنها دور میکنند تا عرصهی فعالیت اقتصاد آزاد را برای اصناف به وجود آورند. در این میان دولتی نیز وجود دارد که شیوهی حد میان را برگزیده است و با مشارکت با اصناف به سازماندهی سازوکار دادوستد میپردازد. روش گردآوری اطلاعات در این تحقیق روش کتابخانهای است که به شکل متن خوانی و فیشبرداری از دادههای اصیل و دست اولی چون کتب علمی و مقالات علمی-پژوهشی فراهم شده است. نتایج این تحقیق نشان میدهد که اگر چه با نگاهی گذرا در قانون نظام صنفی، نقش دولت را هدایتگر و میانه رو در مسائل اصناف در مییابیم، لیکن با تفحص در شاکلهی بنیادی و ساختارهای آن متوجه میشویم که نقش دولت کاملاً حداکثری بوده و تمامی سیاستگذاریها و مدیریتها یا مستقیماً توسط خودش انجام شده یا غیر مستقیم و تحت نظارت و تائید وی به منصهی ظهور رسیده است.
Guilds play a role in the evolution of production and distribution in the field of the market, which can be called as a regulatory institution in the field of economic activities. But in the meantime, according to different adopted policies governments sometimes limit the scope of trade unions activities and interfering in their civil society, they put their free economic activities under supervision and control and sometimes they prevent themselves from interfering in policy making. They remove them in order to create a field of free economic activity for guilds. In the meantime, there is also a government that has chosen the middle way and organize the trading mechanism in partnership with the guilds. the method of collecting information in this research is the library method, which is provided in the form of text reading and scanning of original and first-hand data such as scientific books and scientific research articles. The result of this research show that although with a quick look at the trade union law we find the role of the government as a guide and mediator in the issues of the trade union but by examining the basic structure and its structures we realize that the role of the government is completely maximal and all policies and managements were either directly done by its or indirectly and under its supervision and approval.
