چکیده:
در راستای حمایت از محیط زیست و بدنبال آن مسئول شناختن اشخاص حقوقی حقوق عمومی که بزرگترین عامل تخریب و نابودی محیط زیست هستند درقوانین خلا جدی مشاهده می شود و این درحالیست که مهمترین وخطرناک ترین جرائم توسط اشخاص حقوقی حقوق عمومی که اصولا صنایع مهم و بزرگ را در اختیار دارند ارتکاب می یابد. دربررسی قوانین ایران درماده 688 قانون مجازات اسلامی در می یابیم ،ماده ای عام و کلی وضع شده است که می توان آن را ناظر به جرائم زیست محیطی درمفهوم عام دانست هرچند که مسئولیت اشخاص حقوقی دراین ماده صراحتا اشاره نشده است اما ازعبارت هراقدامی و مرتکبین دراین ماده می توان مسئولیت اشخاص حقوقی را نیز ا حراز کرد البته درنظام حقوقی ایران درقبال جرائم زیست محیطی به صورت محدود جزئی و پراکنده درسایرقوانین مسئولیت کیفری اشخاص حقوقی پذیرفته شده است و اشاره ای به نوع شخص حقوقی نشده است. یافته های این تحقیق که براساس روش تحلیلی-توصیفی و استفاه از ابزار کتابخانه ای و فیش برداری بدست آمده، نشان می دهد که بر اساس قوانین داخلی و اسناد بین المللی همچون کنفرانس استکهلم، قراردادهای چهارگانه 1946 ژنو و دیگر اسنادی که در رساله به آن ها اشاره شده است، اشخاص حقوقی اعم از اشخاص حقوقی حقوق عمومی و حقوق خصوصی در جرایم زیست محیطی دارای مسئولیت کیفری و مدنی هستند و برای این جرایم ارتکابی توسط آن ها مجازات های مختلفی از جمله جرایم مالی و غیر مالی در نظر گرفته شده است.

It has been pointed out that legal entities, including legal entities of public law and private law, have criminal and civil liability in environmental crimes, and for these crimes, various punishments, including financial and non-financial crimes, have been considered.
