چکیده:
زمینه و هدف: پژوهش حاضر با هدف بررسی رویکرد های تبیینی تضاد با تروریسم با تاکید بر انسانی شدن حقوق بین الملل به صورت توصیفی – تحلیلی انجام شده است یافتهها: بی تردید تلاشهای سازمان ملل و در راس آن اقدامات شورای امنیت به عنوان مسئول اولیه حفظ صلح و امنیت بین المللی در مقابله با تروریسم حائز اهمیت است. پیش از حادثه ١١ سپتامبر شورای امنیت چندین قطعنامه در خصوص تروریسم و مبارزه با آن را از تصویب گذراند؛ اما واقعه ١١ سپتامبر شورای امنیت را بر آن داشت تا با تصویب قطعنامه های متعدد و با استفاده از تمام امکانات و ابزارهای موجود مطابق با حقوق بین الملل به مبارزه با این پدیده دهشتناک برخیزد. نتیجه گیری: تروریسم بزرگترین خطر برای صلح و امنیت ملی و بین المللی شمرده می شود. این پدیده به سبب پیوند آن با تکنولوژیهای تازه، به یک گرفتاری راهبردی تبدیل شده و توانسته است گروههایی کوچک، اما با ساختارهای پیچیده را به بازیگران برجسته در پهنه ی بین المللی تبدیل کند. در این سالها، با گسترش پدیده تروریسم، جامعه ی انسانی مورد تهدید قرار گرفته، و این پدیده در درون مرزهای جغرافیایی ویژه ای قرار ندارد و خطری برای جهان شمرده می شود. جرایم تروریستی یکی از جرایم جهان شمول هستند که علاوه بر اینکه به افراد جامعه لطمه وارد میکنند، نظم عمومی را نیز مختل می کنند و در اکثر کشورهای دنیا در حال وقوع، و مایه نگرانی عموم جامعه جهانی است.
Background and purpose: The present study was conducted with the aim of investigating the explanatory approaches to the conflict with terrorism, emphasizing the humanization of international law, in a descriptive-analytical manner. Findings: Undoubtedly, the efforts of the United Nations, and above all the actions of the Security Council as the primary responsible Maintaining international peace and security is important in dealing with terrorism. Before the September 11 incident, the Security Council passed several resolutions regarding terrorism and its fight; But the incident of September 11 prompted the Security Council to fight against this terrible phenomenon by passing numerous resolutions and using all available facilities and tools in accordance with international law. Conclusion: Terrorism is considered the biggest threat to national and international peace and security. Due to its connection with new technologies, this phenomenon has become a strategic problem and has been able to turn small groups, but with complex structures, into prominent players in the international arena. In these years, with the spread of the phenomenon of terrorism, human society has been threatened, and this phenomenon is not located within special geographical boundaries and is considered a danger to the world. Terrorist crimes are one of the universal crimes that, in addition to harming the people of the society, also disturb the public order and are happening in most of the countries of the world, and are a cause of concern for the world community.
