چکیده:
مقاله حاضر با موضوع مبانیء اهداف و فلسفه نظام تقنینی از طبقه بندی مجازاتها تدوین شده است. در این پژوهش برانیم مبنای طبقه بندی مجازاتها موردبررسی قرار گیرد. شناخت دقیق مبانی طبقه بندی مجازاتها در نظام حقوقی آیران کمک می کند تا بتوان در لوایح و یا طرح های آتی که برای اصلاح قوانین مجازات به مجلس ارائه می شوند با تکیه بر پیشینه مطالعاتی قوی و همچنین دوری از تعصبات به ارائه راهبردهای صحیح در طبقه بندی مجازاتها بپردازیم. در این تحقیق روند و پیشینه طبقه بندی مجازات شناسایی و معرفی شده و این نوع طبقه بندی ها با توجه به اهداف آنها موردبررسی و تدقیق قرارگرفته است. برای دستیابی به این اهداف از روش های کتابخانه ای و مصاحبه با رویکرد توصیفی بهره گرفته شده است که برآمد یافته ها بیانگر این است. که در حال حاضر نظام طبقه بندی مجازاتها بیشتر مبتنی بر ماهیت جرم و تاثیر آن بر مجرم است و اهداف مجازات در بخشهای مختلف بیشتر درصدد عبرت آموزی و جبران خسارت بزه دیده و یا تشفی خاطر مجنی علیه تنظیم شده است و اهداف اجتماعی در رویکردهای طبقه بندی مجازات کمتر محل توجه بوده اند
The present article has been compiled with the topic of basics, goals and philosophy of the legal system of classification of punishments. In this research, we want to investigate the basis of classification of punishments. A detailed understanding of the basics of the classification of punishments in Iran's legal system helps to be able to present the correct strategies in the classification in the future bills or plans that are presented to the parliament to amend the penal laws, relying on a strong study background and avoiding prejudices. In this research, the process and background of punishment classification has been identified and introduced, and these types of classifications have been examined and verified according to their goals. To achieve these goals, library methods and interviews with a descriptive approach have been used, and the results of the findings indicate that, currently, the classification system of punishments is mostly based on the nature of the crime and its effect on the criminal, and the goals of punishment in Different departments are mostly trying to learn a lesson and compensate the victim's damage or to heal the victim's feelings, and social goals have been less of a focus in the approaches to classification of punishment.
