چکیده:
اگرچه همه شهروندان در قبال قوانین کیفری در حالت مساوی فرض میشوند، اما سیاستهای جنایی در حال پیشرفت با لحاظ اهداف عالیه حقوق کیفری در قبال برخی اقشار اجتماعی با لحاظ میزان آسیبپذیری، تدابیری افتراقی چه در قواعد شکلی دادرسی و چه در قوانین ماهوی را ترسیم مینمایند. پیشبینی قواعد مربوط به دادرسی افتراقی اطفال و نوجوانان از این دست میباشد. معتادان اگرچه از جمله اقشار بدنام در یک جامعه به حساب میآیند اما بهلحاظ وضعیت خاص جسمی، روانی که از آن رنج میبرند در مواجهه با مقامات تأمین امنیت اجتماع از پلیس تا مقامات قضایی، در صورت عدم تدبیر سیاستهای جنایی افتراقی پیرامون قوانین شکلی دچار چالشهای جدی خواهند بود. در یک وضعیت عادی و در قبال شهروندان عادی، حق بر تفهیم و تشریح اتهام، حق بر سکوت و حتی حق بر تفهیم حق سکوت، حق داشتن وکیل و امثالهم از جمله حقوق دفاعی و شهروندی به حساب میآیند. وقتی با یک متهم معتاد آن هم در حالت خماری روبهرو هستیم، انتظار توجه متهم به حقوق دفاعی خود و استناد و استفاده از آنها انتظار بهجا و صحیحی با امعاننظر به واقعیتهای روحی، جسمی و اجتماعی چنین اشخاصی به نظر نمیرسد. با پیشبینی لزوم شروع به تحقیقات با حضور یک وکیل، معاینه پزشکی، خروج متهم معتاد از خماری با تجویز داروهای مورد نیاز و سایر تضمینات دادرسی عادلانه بهدرستی رعایت خواهد شد.
