خلاصة:
مقاله حاضر به بررسی و تحلیل همکاری علما با حکام جور می پردازد و در آن به تبیین مفهوم واژه «جور» و به تبع آن «حاکم جائر» پرداخته و در ادامه، به تفاوت واژه «جور» و «ظلم» و تقسیم بندی حکام در میراث فقهی شیعه اشاره شده است. از بررسی همکاری علما با حکام جور در ادوار مختلف، این نتیجه به دست می آید که طبق فتوای تمام فقهای شیعه، اصل اولی، حرمت همکاری با حکام جور است و همکاری علما با حکام جور در شرایط خاص، هیچ گاه به معنای مشروع جلوه دادن حکومت جور نبوده؛ بلکه توجه به جنبه های مثبت همکاری، مانند تقیه، مصالح عباد، احیای فریضه امربه معروف و نهی از منکر و...، آنان را ملزم به این همکاری می ساخت.
The present article investigates and analyzes cooperation of ulema with unjust rulers. First the terms "jowr" [injustice] and “ja’er" [unjust or oppressive ruler] have been defined in jurisprudential context followed by a clarification on the difference between "jowr" and "zulm" [oppression]. Later different categories of rulers in jurisprudential legacy of Shi'ism have been mentioned. Having studied cooperation of ulema with unjust rulers in different eras، we see that according to verdicts issued by all Shiite jurisprudents، the primary principle is that cooperation with unjust rulers is haram [forbidden]. However، cooperation of ulema with unjust rulers under special conditions did not in any way mean to legitimize their rule; rather some positive aspects of cooperation such as: taqiyah [the practice of concealing one's beliefs in dangerous circumstances]، public interest or good، revival of amr be ma'roof [commanding the good] and nahy anil munkar [forbidding the evil] made them to cooperate.
