خلاصة:
مناصب سیاسی- اجتماعی زنان از مسائل پرچالشی است که از دیرباز محل مناقشه اندیشمندان بوده است. مرجعیت زنان از مناصب پرچالش اجتماعی مرتبط با حوزه دین است. پژوهش حاضر با هدف بررسی آراء مفسران و فقیهان موافق و مخالف مرجعیت زنان بهروش توصیفی- تحلیلی انجام شد. پژوهش حاضر با تحلیل مهمترین ادله قائلان به عدم جواز مرجعیت زنان توسط فقهای شیعه، به وجوه ناتمام این ادله اشاره کرده و به این نتیجه دست یافت که دلیل قاطع و خدشهناپذیری بر عدم مشروعیت تصدی مرجعیت از جانب زن در دسترس نیست مگر اصرار بر مذاق شارع. لازم است با توجه به تأثیر شرایط زمان و مکان در استنباط فقهی، گسترش مطالبات اجتماعی از سوی زنان و نظرات آیتالله خامنهای در مدیریت اجتماعی کشور، دراینمورد تدقیق بیشتری شود. همچنین در پژوهش حاضر با طرح نظریه تفصیل، بیان شد که اجماع مرکبِ ادعایی در این زمینه، سخن پایانی نیست و برخی از فقها حداقل درباره مرجعیت زن برای زنان، نظر مساعد دارند.
From a long time ago, women's social-political positions have been one of the most
challenging issues that have been the subject of controversy among scholars and one
of the most challenging social positions related to religion has been women's authority.
This descriptive-analytical research aimed to investigate the pros and cons of women's
authority among interpreters and jurists; thus, related sources including research papers
and books of early, late, and contemporary scholars were reviewed, and it was determined
that there was no research that examined the subject of this research. This research first
pointed out the incomplete aspects of the arguments of Shiite jurists, who do not believe
in women's authority, through analyzing the most of those arguments, and it found out
that there is no definite reason, except legislator's understanding (Zogh-e-Share) for the
illegitimacy of women's authority. There is a need to be more careful in this case, because
of the effect of time and place conditions on jurisprudential inference, the expansion of
women's social demands, and Ayatollah Khamenei's ideas on the social management
of our country. Furthermore, by presenting the theory of details in this research, the
compound consensus claimed in this matter is not the final word and at least some jurists
agree with women's authority on women.
