بی تردید علوم اخلاق و حقوق از علوم بسیار مهم انسانی هستند و بحث در مورد رابطه این دو علم از ضروریات است بویژه آن گاه که بحث حقوق کیفری بطور خاص مطرح میشود. به عبارتی مساله این است که آیا حقوق کیفری مطلقا ابزار تضمین حسن اجرای اخلاقیات در جامعه است؟ یا ابزار تضمین حسن اجرای اخلاقیات در جامعه است؟ و یا این که اساسا حقوق کیفری در حوزه اخلاق ورورد نکرده و قواعد آن فارغ از ملاحظات اخلاقی وضع میشود؟ برای یافتن پاسخ سوالات مذکور لازم است در ابتدا مفاهیم حقوق، حقوق کیفری و اخلاق تبیین شوند سپس منشا، قلمرو، هدف و ضمانت اجرای هریک تشریح گردد تا بتوان به رابطه بین این دو شاخه علمی پی برد. کشف این ارتباط، در توجیه وضع و تدوین بسیاری از قوانین کیفری که علیرغم ماهیت اصلی قواعد کیفری، در حوزه زندگی خصوصی افراد ورود کردهاند و بنابراین، تنها راه مقابله با کجی و کجروی، توسل به حربه کیفر نیست و کیفر همواره ابزار کارآمدی برای حمایت از اخلاق نبوده و لاجرم ضمانت اجراهای غیرکیفری نیز وجود دارند که نباید از نقش موثر آنها غافل شد؛ زیرا انتظار حداکثری از دولت و حقوق کیفری برای چاره اندیشی در برابر پدیدههای ضداخلاقی که ضرر ملموسی ایجاد نمیکند، از یک سو به حس بیاعتمادی نسبت به شهروندان و جامعه مدنی در کنترل و مبارزه با کجروی دامن میزند و از سوی دیگر بستری را برای دست کشیدن از ارزشهای انسانی و دستیازیدن به استبداد قانونی برای تحکیم وحدت اخلاقی و مناسبات اجتماعی مطابق خواست اکثریت فراهم میکند.
