خلاصة:
حقوق مالکیت ادبی و هنری در راستای حمایت از مؤلفان و هنرمندان از یک سو و حمایت از حقوق جامعه (منافع عمومی) از سوئی دیگر، به مؤلفان و هنرمندان حقوق انحصاری میدهد. مؤلف میتواند به استناد داشتن این حقوق در مدتی موقت، از تجاریسازی اثر خود کسب درآمد نموده (حق مادی) و نام خود را به عنوان پدیدآورنده برای همیشه در تاریخ و فرهنگ بشریت ثبت نماید. (حق معنوی) قانونگذاران ملی و بینالمللی، به گونهای این حقوق را برای مؤلفین تدارک دیدهاند که مانع سوءاستفاده آنها از این حق و تحدید حقوق جامعه میشود. یکی از مصادیق حقوق جامعه، حق دسترسی به اطلاعات است. در نگاه اول به نظر میرسد که حق انحصاری مؤلف، محدود کنندۀ این حق جامعه باشد، اما با نگاهی به مبانی مالکیت فکری به طور عام و مالکیت ادبی و هنری به طور خاص و همچنین بررسی دقیق مقررات ملی و بینالمللی نتیجه میشود که نه تنها این انحصار، تأمینکننده سلامت و اصالت اطلاعات و محصولات فرهنگی بوده و از این جهت با منافع جامعه همسو است، بلکه محدودیتها و استثناهای وارد بر آن نیز مانع نقش محدودسازی کپیرایت در دسترسی عموم به اطلاعات میشود. علاوه بر این پیشبینی حق معنوی برای مؤلف، اصالت و سلامت اطلاعات را در پی داشته و موجب برخورداری جامعه از اطلاعات اصیل و با منشأ مشخص میشود. در این خصوص مفاد ماده 19 لایحه حمایت از مالکیت ادبی و هنری و حقوق مرتبط و مادتین 2 و 2 مکرر کنوانسیون برن در دو سطح ملی و بینالمللی قابل توجه است.
Copyright grants authors and artists, exclusive rights to protect authors and artists, on the one hand and to protect community rights on the other hand. The author can, for a temporary period of time, earn from the commercialization of his work and register his name as the creator forever in the history and culture of humanity. National and international legislatives have provided these rights to authors in a way that prevents them from abusing this right and restricting the community rights. One of the examples of community rights is the right of access to information. At first glance, copyright seem to limit this right of society, but with a look at the foundations of intellectual property, in general, and at the foundations of copyright, in particular, as well as careful scrutiny of national and international regulations, concludes that not only does this monopoly guarantee the intactness and originality of information and cultural materials, and is in line with the public interests, but also the limitations and exceptions to it, impede the copyright restrictive role on the right of access to information. In addition, prediction of moral right of the author leads to originality and authenticity of information and enables the community to enjoy original and authentic information with a definite and certain source. In this respect, the provisions of Article 19 of the Bill on the Protection of Literary and Artistic Property and the Articles 2 and 2bis of the Berne Convention at national and international levels are significant.
