گسترش آلودگیهای مختلف، تغییر آب و هوا، تحلیل لایه ازن، کاهش تنوع زیستی و تعداد بی شمار معضلات زیست محیطی که حیات انسانها را در کره خاکی تهدید میکنند و کیفیت حیات را به شدت تقلیل دادهاند واقعیت انکار ناپذیر است که جامعه بین المللی سخت با آن دست به گریبان است. جای بسی تأسف است که با صنعتی شدن بشر و بهره برداری بی رویه از طبیعت کاهش یافته است. اصل توسعه پایدار که کنفرانسهای 1972 استکهلم و 1992 ریودوژانیرو سنتزو نقطه تعادل بهره برداری از محیط زیست ضمن احترام به حقوق نسلهای آینده قلمداد شده است هنوز در حد یک اصل راهنمای کلی مورد توجه و عمل قرار نگرفته است. تعهد و مسئولیت بین المللی دولتها در محافظت از محیط زیست که در مواد 21 اعلامیه استکهلم و 12 اعلامیه ریودوژانیرو انعکاس یافته است در رویه قضایی و داوری بین المللی و نیز در اسناد بین المللی در چارچوب مسئولیت حقوقی (مدنی) دولتها در عدم آلودگی محیط زیست و جبران خسارت وارده به خوبی تثبیت شده است. از سوی دیگر در نظامهای حقوقی ملی نیز محیط زیست با وضع و اعمال ضمانتهای اجرائی مدنی و کیفری در قبال آلودگی مورد حمایت قرار گرفته است، هر چند که این ضمانتهای اجرائی گاه به علت موانع صلاحیتی عملاً بلا استفاده میمانند و یا تشتت قوانین ملی و فقدان انگیزههای کافی برای مقابله با آلایندههای زیست محیطی ناشی از فعالیت تأسیسات دولتی یا عمومی، حمایت مؤثر از محیط زیست را دور از دسترس مینماید.سوالی که در اینجا مورد نظر است این است که خسارت زیست محیطی و نحوه جبران آن در حقوق بین الملل چگونه می باشد؟ که این پژوهش با روش توصیفی-تحلیلی و گردآوری اطلاعات از روش کتابخانهای به دنبال پاسخگویی به این سوال است .

The principle of sustainable development, which the 1972 Stockholm Conference and the 1992 Rio de Janeiro Synthesis are considered to be the equilibrium point of environmental exploitation while respecting the rights of future generations, has not yet been considered as a general guiding principle. The international commitment and responsibility of States in protecting the environment, as reflected in Articles 21 of the Stockholm Declaration and 12 of the Rio de Janeiro Declaration, in international jurisprudence and arbitration, as well as in international instruments within the framework of States' legal (civil) liability for non-pollution And the compensation is well established. On the other hand, in national legal systems, the environment is protected by the imposition of civil and criminal enforcement guarantees against pollution, although these enforcement guarantees are sometimes practically unusable due to legal obstacles or the fragmentation of national laws and lack of Adequate incentives to deal with environmental pollutants from the operation of government or public facilities make effective environmental protection out of reach. The question that arises here is what environmental damage is and how it is compensated under international law. ? This research seeks to answer this question by descriptive-analytical method and collecting information from the library method.
