خلاصة:
اصل تسلط طرفین بر تعیین قلمرو امور موضوعی دعوا که در حقوق فرانسه به le princip dispositif شهرت دارد اقتضا میکند دادرس حق و تکلیفی نسبت به تعیین موضوع دعوا و قلمرو آن نداشته باشد. دادرس موظف است در محدوده و چارچوب امور موضوعی که طرفین تعیین نمودهاند به دعوا رسیدگی کند. با این وجود گاه آنچه که خواهان تحت عنوان «خواسته» در دادخواست خود ذکر میکند چنان قرابت و ملازمه عقلی و منطقی با اثبات یا نفی امور دیگر دارد که موجب میشود دادرس بدون رسیدگی به این امور امکان رسیدگی به خواسته را نداشته باشد. تردید نسبت به تکلیف دادگاه برای رسیدگی به این امور و اثبات یا نفی خود به خود آنها از جایی نشات میگیرد که این امور به صورت صریح و مستقیم جزو خواسته ی خواهان قرار نگرفته است اما بنا به طبیعت دعوا، اثبات خواسته مستلزم اثبات لوازم آن نیز میگردد. در این نوشتار در صدد اثبات این فرضیه هستیم که خواسته لوازم عقلی و منطقی مترتب بر خود را ثابت میکند و چنین امری منافاتی با اصل تسلط طرفین بر قلمرو امور موضوعی و اصل تغییر ناپذیری دعوا ندارد.

The reluctance of the court to deal with these instances stems from the fact that these matters have not been explicitly and directly mentioned in the petition, but according to the nature of the claim, the proving the demand would requires proof of its necessity. In this article we are trying to prove the hypothesis that the demand proves rational and logical requirements and it is not in conflict with the principle of dominance of the parties over the matter of fact and the principle of immutability of litigation.
