خلاصة:
زمینه و هدف: حق بر سلامت به عنوان یکی از مهمترین مصادیق حقوق بشر محسوب میشود. این حق در اعلامیه جهانی حقوق بشر در قامت یک اصل کلی مورد پذیرش قرار گرفته است. پس از اعلامیه جهانی حقوق بشر نیز میثاق حقوق اقتصادی، اجتماعی و فرهنگی به تصویب رسید که با اقبال جامعه بینالمللی مواجه شد.
مواد و روشها: در این مطالعه با روش تحلیلی ـ توصیفی، ابتدا نقطه سرآغاز شناسایی حق بر سلامت در قامت یک اصل کلی مورد بررسی قرار خواهد گرفت و در ادامه نیز حق مزبور و مصادیق آن در میثاق حقوق اقتصادی، اجتماعی و فرهنگی و در نهایت تحولات راجع به توسعه مفهومی و مصداقی این حق در برخی کنوانسیونها و اسناد حقوق نرم مورد توجه قرار خواهد گرفت.
یافتهها: در پژوهش حاضر، مشاهده خواهد شد که حق بر سلامت با ادبیاتی بسیار کلی و مبهم مورد شناسایی قرار گرفته است. این ویژگی خاص میثاق باعث شده است که دولتها برای تعیین قلمرو دقیق تعهدات ناشی از حق بر سلامت به رویه بینالمللی متوسل شوند. در همین راستا، ساز و کار گزارشهایی که تحت عنوان «دیدگاههای عمومی» در ارتباط با مفاد میثاق منتشر میشوند، کمک بسیار مهمی را در ایجاد همگرایی و وحدت رویه بینالمللی در میان بازیگران دولتی و غیر دولتی ایفا نموده است.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
نتیجهگیری: در پژوهش حاضر مشاهده شد که در زمینه حق بر سلامت، نیاز فوری برای ایجاد هنجارهای جدید حقوق بشر وجود ندارد. چارچوب حقوقی موجود، زمینه کافی برای تفسیر تکاملی ماده 12 میثاق حقوق اقتصادی، اجتماعی و فرهنگی را فراهم میکند، و مفسران (نهادهای بینالمللی معاهداتی، دولتهای طرف میثاق، سازمانهای غیر دولتی و سایر ذینفعان) را قادر میسازد تا در زمینههایی که در گذشته کمتر مورد توجه قرار داشتهاند، مانند حقوق جنسی، تولید مثل، گرایشهای جنسی، مسائل مروبط به سلامت در زندانها و مخاصمات مسلحانه، بیش از پیش مورد توجه قرار دهند.
Background and Aim: The right to health is one of the most important
examples of human rights. This right is recognized in the Universal
Declaration of Human Rights as a general principle. Following the Universal
Declaration of Human Rights, the Covenant on Economic, Social and
Cultural Rights was adopted, which was welcomed by the international
community.
Materials and Methods: In this study, by analytical-descriptive method,
first the starting point of identifying the right to health as a general principle
will be examined and further this right and its examples in the Covenant of
Economic, Social and Cultural Rights and Finally, developments regarding
the conceptual and practical development of this right will be considered in
some soft law conventions and instruments.
Findings: In the present study, it will be observed that the right to health
has been identified with a very general and vague literature. This special
feature of the Covenant has led states to resort to international practice to
determine the precise scope of obligations arising from the right to health. In
this regard, the mechanism of reports published under the heading "Public
Opinions" on the provisions of the Covenant has played a very important
role in creating convergence and unity of international practice among
governmental and non-governmental actors.
Ethical Considerations: In order to organize this research, while observing
the authenticity of the texts, honesty and fidelity have been observed.
Conclusion: In the present study, it was observed that in the field of the
right to health, there is no urgent need to create new human rights norms.
The existing legal framework provides sufficient grounds for the
evolutionary interpretation of Article 12 of the Covenant on Economic,
Social and Cultural Rights and enables commentators (international treaty
bodies, Covenant States, NGOs and other stakeholders) to address areas
that have received little attention in the past such as sexual rights,
reproduction, sexual orientation, health issues in prisons and armed conflict,
