اهداف
هدف این مطالعه شناسایی چالشهای مشارکت مردم در قانونگذاری در بخش سلامت در ایران است.
روش بررسی
مطالعه حاضر از نظر هدف، اکتشافی و از نظر فرایند اجرا، کیفی بود. روش گردآوری دادهها با روش مصاحبه نیمه ساختارمند و هدف دار با شرکت کنندگان انتخابی بود. جامعه پژوهش مشتمل بر افراد آگاه و کلیدی (شامل اساتید دانشگاه، نمایندگان مجلس، وزراء سابق بهداشت، کارشناسان معاونت قوانین مجلس، کارشناسان حوزه سلامت و حقوقی مرکز پژوهشهای مجلس، صاحبنظران و مدیران شاغل در حوزه قانونگذاری سلامت با حداقل 10 سال سابقه کار بود. این افراد در زمینه قانونگذاری تجربه داشته و همچنین در خصوص نظام سلامت کشور نیز آگاهی کافی داشتند. ﺗﻤﺎﻣﯽ ﻣﺼﺎﺣﺒﻪ ﻫﺎ ﺿﺒﻂ و ﺳﭙﺲ به صورت متن بازنویسی گردید. تحلیل دادهها با استفاده از روش تماتیک انجام گرفت.
یافته ها
ﺑﺮ اﺳﺎس ۲۰ ﻣﺼﺎﺣﺒﻪ ی اﻧﺠﺎم ﺷﺪه در این مطالعه ۵ درون مایه اصلی و ۲۶ درون مایه فرعی (طبقه) ایجاد شد. گروه اصلی مشتمل بر عوامل قانونی، عوامل زیر ساختی، عوامل فرهنگی و اجتماعی، عوامل مربوط به مشارکت کنندگان (مردم) و عوامل مربوط به مشارکت پذیران (قانونگذاران) بود. در عوامل قانونی ۳ زیر طبقه ساختار پارلمان، الزامات قوانین برای نظر خواهی و تسهیلات قوانین؛ در عوامل زیر ساختی ۷ زیر طبقه شبکه ارتباطات وجود وسایل ارتباط جمعی، اطلاع رسانی، امکان دسته بندی نظرات، امکان مشارکت الکترونیک، امکانات مالی، امکانات ساختاری و امکان دسترسی/ملاقات با قانونگذاران؛ در عوامل فرهنگی و اجتماعی ۳ زیرطبقه مشارکت جویی مردم، اعتقاد به کار گروهی و سرمایه اجتماعی؛ در عوامل مربوط به مشارکت کنندگان دسترسی به اطلاعات، دسترسی به قانونگذاران، دریافت پاسخ یا بازخورد از قانونگذاران، احساس امنیت پس از ارائه مشورت، میزان آگاهی مردم از حقوق خود، آموزش، امکان تبادل نظر و وجود تیم کارشناسی قوی و در عوامل مربوط به مشارکت پذیران ۹ زیرطبقه میل به استفاده از نظرات دیگران، ظرفیت پذیرش نظرات متفاوت، عوامل حزبی، عوامل و مصالح منطقهای، سلامت اداری، آموزش، فرصت کافی، الویتها و عوامل انگیزشی ایجاد شد.
نتیجه گیری
چالشهای متعددی در مشارکت شهروندان در فرآیندهای قانونگذاری در بخش سلامت وجود دارد. در حوزه قوانین لازمست حق مشارکت شهروندان در سیستم حقوقی مشخص شود. برای رفع چالشهای فرهنگی و اجتماعی باید شفافیت و تبلیغات حداکثری برای مشارکت مردم باید صورت پذیرد. در این بین نمایندگان نیز نیاز به آموزش دارند تا بتوانند از ظرفیت مشارکت جامعه استفاده کنند. از طرفی مشارکت کنندگان نیز علاوه بر تسلط بر دانش در حوزه سلامت باید بتوانند به زبان سیاستگذاران نیز سخن بگویند.
Objective: The purpose of this study is to identify the challenges of legislative participation in the health sector in Iran.
Materials & Method: The present study was exploratory and qualitative in terms of implementation process. The method of data collection was semi-structured and purposeful interviews with the selected participants. Experts in the field of health law (with at least 10 years of experience) who were skilled in the field of law and were knowledgeable about the health system of the country were selected based on a series of urgent interviews. It was completely simplified data were analyzed using thematic analysis.
Results: We found 5 main categories and 26 subcategories. The main group consisted of legal factors, infrastructure factors, cultural and social factors, stakeholders (people) and legislators.In the Facilities Laws; three subcategories were created; the structure of parliament, the requirements of the rules for opinion and the facilities of the laws. In the infrastructure factors identified seven subcategories of communications networks: media, information, opinion grouping, electronic participation, financial opportunities, structural facilities and access / meeting with legislators. In the social and Cultural factors; three subcategories were created; subculture of people participation, belief in teamwork and social capital. Factors related to people were identified in the eight sub-categories of access to information, access to legislators, response or feedback from legislators, a sense of security after consultation, the extent of public awareness of their rights, training, the ability to exchange opinions and the presence of a strong expert team. In the context of legislators, nine subcategories were created; the desire to use otherschr('39') opinions, the capacity to adopt different opinions, party factors, regional factors, administrative health, education, opportunity, priorities, and motivational factors was created.
Conclusion: There are several challenges for citizens to participate in the legislative process in the health sector. In the field of law, it is necessary to determine what the right of citizens to participate in the legal system is. Representatives also need training in order to make use of the capacity of community participation. On the other hand, in addition to mastering health knowledge, participants must also be able to speak the language of policymakers.
