خلاصة:
طبق ماده140 قانون مدنی آلمان که بیانگر نظریه تحول است؛ درصورتی که عمل حقوقی باطلی؛ متضمن ارکان عمل حفوقی صحیح
دیگری باشد، در صورت احراز اراده فرضی طرفین توسط دادرس، عمل حقوقی باطل به به عمل حقوقی صحیح متحول می گردّد. هدف
از مقاله پیش رو روشن شدن مفهوم نهاد تحول و تمایز آن با نهادهای مشابه در دکترین حقوفّی معاصّر است. برای دستیابی به اهداف
مزبور، تلاش گردیده با استفاده از رویکرد توصیفی- تحلیلی و استفاده از روش کتابخانه ای ابعاد مفهومی و مکانیسم نظریه تحول
تشریح شود. بنا بر یافته این تحقیق، کاهشی بودن فرایند تحول و مانعیت ورود عناصر خارجی به عمل حقوقی دو ویژگی اصلی
این نهاد است که به سبب آنها از نهادهای مشابه، همچون بطلان جزئی، تبدیل تعهد، تصحیح عقد و توصیف عمل حقوقی متمایز
می گردد. با در نظر گرفتن نتایج این پژوهش میتوان گفت نهاد تحول عمل حقوقی، نهادی اصیل و علیرغم مشابهت با برخی از
نهادهای حقوقی، دارای مفهومی متفاوت و مستقل است.

To achieve these goals, a descriptive-analytical approach has been used. Reduction of the transformation process and prevention of the entry of foreign elements into the legal practice are the two main features of this institution that distinguish it from similar institutions such as partial invalidity, Novation, corrections of the contract and qualification. it can be said that the institution conversion legal act is a genuine institution and despite its similarity to some legal institutions, it has a distinct and independent concept
