خلاصة:
زمینه و هدف: اصلاح فرآیندهای رسیدگی در نظام قضایی جمهوری اسلامی ایران، یکی از امور ضروری جهت بهبود و افزایش کارآمدی این نظام است. به همین منظور قوه قضائیه همواره تلاش داشته است تا امکان حداکثر بازدهی در رسیدگی به پرونده‌ها ایجاد گردد. تا ضمن کوتاه شدن زمان دادرسی و تسریع در تصمیم‌گیری‌ها، اطاله دادرسی ناشی از معیوب بودن فرآیندهای دادرسی نیز از بین برود.
مواد و روش‌ها: این تحقیق از نوع نظری بوده روش تحقیق به‌صورت توصیفی تحلیلی میباشد و روش جمعآوری اطلاعات به‌صورت کتابخانهای است و با مراجعه به اسناد، کتب و مقالات صورت گرفته است.
ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانت‌داری رعایت شده است.
یافته‌ها: به‌طورکلی اقدامات قوه قضائیه درزمینه اصلاح فرآیندهای رسیدگی را در دودسته می‌توان تقسیم‌بندی نمود. نخست اقداماتی که ناظر بر طرح صحیح دعاوی در محاکم هستند و قلمرو اعمال آن‌ها قبل از طرح دعاوی است؛ و دوم اقداماتی که ناظر بر مدیریت قضایی می‌باشند و در زمان دادرسی‌ها مورداستفاده قرار می‌گیرند.
نتیجه‌گیری: وظیفه محاکم قضایی از زمان تسلیم شکایت یا تقدیم دادخواست آغاز شده و قبل از آن وظیفه خاصی که به اطاله دادرسی مربوط می‌شود به عهده آنان نیست. شکایت و اعلام جرم و دادخواست نقطه آغاز جریان دادرسی است؛ بنابراین تدوین و نگارش صحیح و رعایت اصول این اقدام که در قوانین آیین دادرسی به آن‌ها اشاره شده است می‌تواند از تأخیر در رسیدگی تا حدی جلوگیری کند.
Background and Aim: Reforming the judicial processes in the judicial system of the Islamic Republic of Iran is one of the essential issues to improve and increase the efficiency of this system. To this end, the judiciary has always strived to ensure maximum efficiency in handling cases. In order to shorten the time of the trial and expedite the decisions, the delay of the trial due to the defectiveness of the proceedings should also be eliminated. Materials and Methods: This research is of theoretical type and the research method is descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles. Ethical Considerations: In order to organize this research, while observing the authenticity of the texts, honesty and fidelity have been observed. Findings: In general, the actions of the judiciary in reforming the judicial process can be divided into two categories. First, the actions that oversee the proper filing of lawsuits in the courts and the scope of their action before filing lawsuits; And second, the actions that oversee judicial management and are used during trials. Conclusion: The jurisdiction of the courts has begun since the filing of the complaint or the filing of the petition, and before that they have no specific duty relating to the adjournment of the proceedings. The complaint and the declaration of the crime and the petition are the starting point of the trial; Therefore, the correct formulation and observance of the principles of this action, which are mentioned in the rules of procedure, can prevent delays in the proceedings to some extent.
