چکیده ایده «مسوولیت حمایت» در سال 2001 برای اولین بار در گزارش کمیسیون بینالمللی مداخله و حاکمیت مطرح گردید و در سال 2005 در اجلاس سران توسط مجمع عمومی به طور رسمی پذیرفته شد. نظریه مسوولیت حمایت در سال 2006 توسط قطعنامههای 1674و 1706 شوری امنیت مورد تاکید قرار گرفت، بان کیمون دبیر کل سازمان ملل، نیز در 18 ژانویه 2012 بر آن تاکید کرد. با توجه به تجارب موفق و ناموفق مداخلات بشردوستانه در دهه 1990 نظریه مسوولیت حمایت در صورت بدون نتیجه ماندن اقدامات صلح آمیز و به بن بست رسیدن شورای امنیت در اتخاذ تصمیم در مواجه با وضعیتهای نقض فاحش، گسترده و سیستماتیک حقوق بشر، نسل کشی، جنایت علیه بشریت یا تجاوز، اقدام نظامی یا اقدام کم شدت نظامی مانند ایجاد منطقه پرواز ممنوع یا مناطق امن را با هدف محافظت از مردم غیر نظامی در قالب رکن سوم نظریه مسوولیت حمایت و بدون مجوز شوری امنیت مجاز میداند. این مقاله به بررسی مفهومی و مبانی نظری مسوولیت حمایت در معاهدات بینالمللی، حقوق بینالملل عرفی، قطعنامههای شوری امنیت، اظهارات دبیر کل سازمان ملل و نهایتا رویه دولتها میپردازد .
The efforts that have been done by International Powers to make strategic changes in Middle East did not stop by failure of Greater Middle East Initiative, this strategic approach continued within new forms like putting curb on Arabic Revolutions or management of them, naked regime change by military intervention and etc. this new interventionist approach utilizes claims like human rights, protection of civilians against their so-called illegal regimes, making fabricated and makeshift oppositions, and providing support to pro separation forces from mainland. The idea of humanitarian intervention and “responsibility to protect” are amongst doctrines that exploited by west to intervene in Middle Eastern and African countries like Syria, Iraq, and Libya. The idea of Responsibility to protect was mentioned in the report of International Commission on Intervention and Sovereignty and in 2005 it was admitted officially in annual summit of General Assembly. In 2006,the theory of R to P was reiterated by 1674 and 1706 UNSC resolutions, also in January 2012, UN secretary General Ban Ki Moon put emphasize on the this emerging theory. This article is about to make elaboration on conceptual and theoretical aspects of theory according to international treaties, international customary law, UNSC resolutions, UN secratery general statements, practice of states. The authors do believe that this doctrine shape new form of interventionism and will be resorted as an instrument to make regime change within unfavorable regimes including Syria. Despite the fact that disagreement of UNSC has been made illegal any sort of intervention in Syria.

اين مقاله به بررسـي مفهومي و مباني نظري مسـئوليت حمايت در معاهدات بين المللي ، حقوق بين الملل عرفي ، قطعنامه هاي شوراي امنيت ، اظهارات دبيرکل سـازمان ملـل و نهايتا رويه ي دولت ها مي پـردازد و اين ايده را مطرح مي کند که نظريه به شکل جديدي از مداخله گرايي غربي در سوريه دامن زده و مي تواند دسـتاويز تغيير رژيم و بي ثبات سازي نظام هاي نامطلوب از منظر غرب در خاورميانه از جمله سوريه قرار گيرد.
ICISS(The International Commission on Intervention and State Sovereignty) ماندن اقدامات صلح آميز و به بن بسـت رسيدن شوراي امنيت در اتخاذ تصميم در مواجه با وضعيت هاي نقض فاحش ، گسترده و سيستماتيک حقوق بشر، نسل کشـي ، جنايت عليه بشـريت يا تجاوز و اقدام نظامي ، اقدامات کم شدت نظامي ماننـد ايجاد منطقـه ي پرواز ممنوع يا مناطق امن را با هـدف محافظت از مردم غير نظامي در قالب رکن سوم نظريه ي مسئوليت حمايت و بدون مجوز شوراي امنيت ، مجاز مي داند.
