خلاصة:
با تصویب قانون عملیات بانکی بدون ربا در شهریور 1362، سعی قانون‌گذار بر این بوده است که عملیات بانک‌ها را بر معیارهای اسلامی منطبق سازد. اما با غور و بررسی رابطه‌ای که از یک طرف بین سپرده‌گذاران و بانک‌ها و از طرفی دیگر بین بانک‌ها و سرمایه‌گذاران به وجود می‌آید به وضوح مشخص می‌شود که قانون‌گذار بیشتر در صدد توجیه رویه بانک‌ها برآمده است تا اینکه بخواهد سیاست‌های پولی مطابق با موازین شرعی را اعمال نماید. به هـرحال فقه اسـلامی نمی‌تواند از ماهیت و مسائل مربوط به سپرده‌گذاران بانکی با توجه به عملیاتی که این مؤسسه عظیم مالی انجام می‌دهد غافل شود، لذا قانون عملیات بانکی بدون ربا در شهریور 1362 به تصویب رسید و از اول سال 1363 به مرحله اجرا درآمد. بر اساس یافته‌های این تحقیق یا باید به اراده و توافق طرفین (سپرده‌گذار و بانک) احترام گذاشت و این نوع قراردادها را نافذ دانست و یا اینکه به واسطه فراگیر بودن دین مبین اسلام با تفحص و غور در منابع فقهی درصدد پاسخ به نیازهای جدید بشر برآییم. کما اینکه با شرایط زمان و مکان تطور و تحول زیادی در احکام استنباطی به وجود آمده است. در این راستا نقشی که رسانه‌ها در پویایی و غنابخشی به اینگونه موضوعات ایفا می‌کنند بر کسی پوشیده نیست.
