خلاصة:
زمینه و هدف: شکلگیری حقوق محیط زیست، در پاسخ به برخی بحرانهای اخلاقی ـ فلسفی دوره مدرن بوده است. سوال اساسی این است که از لحاظ مبانی، حقوق محیط زیست با چه چالشهای اخلاقی در دوره مدرن مواجه است؟ در این مقاله کوشیده شده است، برخی چالشهای اخلاقی دوران مدرن در ارتباط با حقوق محیط زیست، تحلیل و ارزیابی شوند.
مواد و روشها: این مطالعه با روش تحلیلی ـ توصیفی و با استفاده از منابع کتابخانهای و سایر منابع در دسترس به مساله فوق پرداخته است. رویکرد روششناختی پژوهش حاضر هم مبتنی بر دگماتیسم حقوقی (توصیف نظام حقوقی موجود) و هم روش سیستمی (نقد کفایت، سودمندی و کارکرد قواعد کنونی) است.
ملاحظات اخلاقی: در تمامی مراحل نگارش مقاله، صداقت و امانتداری رعایت شده است.
یافتهها: اجمالا چهار دسته چالش اخلاقی تحلیل شده است: 1ـ چالش انسانمحوری و خودمحوری؛ 2ـ دوگانهانگاری محیطی؛ 3ـ فایدهگرایی و اصالت سود؛ 4ـ ارزش ابزاری طبیعت. در نهایت از ضرورت توجه اخلاقی به حقوق محیط زیست و توجه به اخلاق جدیدی تحت عنوان «اخلاق زمین» دفاع شده است. فرض اساسی این مقاله بر این مبنا استوار است که مبانی اخلاقی مدرنیته در ارتباط با بهرهبرداری از محیط زیست و منابع طبیعی نیازمند بازبینی جدی است، چه اینکه نمیتوان بدون توجه به چالشهای مذکور به حفاظت از محیط زیست و کارآمدی نظام حقوق محیط زیست در جهان خوشبین بود.
نتیجهگیری: در نظام حقوق محیط زیست با چهار دسته چالش اخلاقی فوق مواجهیم. این دانش جهت رسیدن به اهداف غایی خود نیازمند توجه به این مبانی به ویژه در وضع قوانین و مقررات زیستمحیطی است.
Background and Aim: The formation of environmental rights has been
in response to some of the ethical-philosophical crises of the modern
era. The main question is what are the ethical challenges of
environmental law in the modern era? This article attempts to analyze
and evaluate some ethical challenges of the modern era in relation to
environmental law.
Materials and Methods: This study analyzes and evaluates the above
problem using analytical-descriptive method and library resources and
other available resources. The methodological approach of this paper, in
addition to describing the existing situation (dogmatism), is based on a
systematic approach (critique of the adequacy and usefulness of the
environmental legal and ethical system).
Ethical Considerations: In order to organize this research, while
observing the authenticity of the texts, honesty and fidelity have been
observed.
Findings: Four categories of ethical challenges are briefly analyzed: 1.
These four challenges contain the human-centered (Anthropocentrism)
or self-centered challenge; 2. Environmental dualism; 3. Utilitarianism
and originality of profit; 4. The instrumental value of nature. Finally the
need for ethical attention to environmental law and a new ethics called
the "Earth Ethics" has been defended. The basic presumption of this
article is based on the belief that the moral foundations of modernity in
relation to the exploitation of the environment and natural resources
need serious revision.
Conclusion: There are four ethical challenges in the environmental law
system. To achieve its ultimate goals, this science needs to pay
attention to these principles, especially in enacting environmental laws
and regulations.
