یکی از فوایدی که پژوهشگران «حقوق تطبیقی » برای مطالعات آن برمیشمارند، پیبردن به نقاط قوت و ضعف موضوع موردمطالعه در نظامهای مختلف است. «ذمهّ » یکی از مفاهیم پرکاربرد در حقوق اسلامی و فقه است؛ بهگونهای که میتوان کاربرد آن را از باب عبادات تا قصاص و دیات، در فقه مشاهده کرد؛ با وجود این، تعریفی از آن در قانون دیده نمیشود. ذمهّ در حقوق اسلامی بهعنوان محلی اعتباری برای تعلق دیون شناسایی شده است که همین مفهوم با اندکی تغییر در حقوق فرانسه با عنوان «دارایی » آمده است. سوال اصلی این تحقیق این است که این دو چه نسبتی از «نسب اربعه »، با یکدیگر برقرار کردهاند و آثار هریک از این دو نهاد چیست. بهعبارت دیگر، این دو نهاد چه شباهتها و چه تفاوتهایی با یکدیگر دارند؟ در فرآیند تحقیق، به این برآیندها میرسیم که نهاد ذمهّ، دارای امتیازاتی همچون عامبودن از حیث موضوع، استمرار بقا حتی پس از فوت شخص و داشتن شخصیت حقوقی است و این امور باعث برتری نهاد ذمهّ بر نظریة دارایی است. در این تحقیق از روش مطالعه تطبیقی خرد و کتابخانهای، استفاده شده است.
To identify the strengths and weaknesses of matters based on their study in different systems has been considered as one of the advantages for such studies we present, by scholars of comparative law. Liability is one of the most widely used concepts in Islamic law and jurisprudence. Its application can be seen from worship issues to retribution and Diyat (blood money) in jurisprudence. However, there is no definition for liability in the law. In the Islamic law, the liability is a conceive subject for owning the debts, which is known as title of possessions. The main question of this research is to find the relation between these two titles in accordance to logical quadratic relation of subject and the effects of each of them. In other words, what are the similarities and differences of these institutions? In the process of research, it has been concluded that the institution of liability has characteristics and advantages such as generality in its subject, its permanent continuity even after the death of poser and its legal personality, the issues which give superiority of the liability institution over the possession institution. This research has been compiled by a library method and minor comparative study approach.
